I am illegally here in Switzerland, I have a passport with my expired Schengen visa.
I am currently living with my boyfriend a EU national and two days ago I confirmed that I am pregnant.
I am from a third world country.
My boyfriend and I visited the Municipal office to officially say that we are living together and we were redirected to the Cantonal Police . They interviewed us and got my passport. I have to wait for the results.

Questions
1. Are they going to send me home?
2. How many days will the authorities going to check and verify all my documents?
3. Is there a strong possibility that they will grant a visa and later a permit for me to stay?

Congratulations on the pregnancy - easiest option would be to marry your boyfriend. This would solve pretty much all of your problems......you might hear something about the fact that you're seemingly illegal in the country though.

Seek the counsel of an immigration lawyer (or solicitor - however they are called in Switzerland).

It is not opportune time to get married for personal issues on his side. That makes me doubly illegal...

Is he married? If he is not and he's prepared to get you pregnant, in my opinion he should be prepared to do anything to keep you and his unborn child in the country.

I assume you're trying to set up a civil partnership. I don't know how this might be affected if he is already married.

Yeah, he is still married but separated for some 2 years. He is just about to start in the divorce, that is why he opts for now to let it out in the open by going to the community to officially state that we are cohabiting.

I guess if I will have a visa first and a residence permit afterwards things will be ok.

Life is complicated for me. I am just positive that things like the baby along the way is a kind of blessings.

I wish you all the best of luck. I hope things work out as you wish. If things get difficult it may be worth phoning your country's embassy in CH (or going to see the consulate if they have one in Geneva) to see if they can give you advice/help.

I know that the first trimester is not a good time to look for a job (or anytime during pregnancy), but just in case any of us hear of anything it would be nice to know what you can do. -- ~~~~

well....i agree with MarkJ...even though its tough and even not adviced to work hard during pregnancy..i suppose you should look for a job...but remember the work laws are tough too ....and it depends on your skills...while a prospective employer will have to apply for a permit from the quota system for non EUs.
I dont know how will the Cantonal police react but it pretty depends on individual cases and often the official handling it.
I see a 50 - 50 in this case and the possibility is more to get deported.
Well..also a divorce process depending on the situations may take from 4- 6 months and in some cases may be upto 2 years.

Whatever happens I will be ready! The Swiss society is strict and I know the consequences of our coming out. I always believe that things happen with a purpose, so right now Im just putting all my hopes. It's not a hopeless case, I just fall in love and having a baby because of it. I will be brave no matter what.

what about taking up a course at a FH or Uni? You can get a student visa.

it seems that getting a student visa is a quicker and legal way to stay. Even though your passport is being taken, you could still start searching for the appropriate course etc etc.
