Foreign Father of a Swiss Child

Hello,

I am a Venezuelan father of a Swiss child, I get separated from his mother before apply for any paper, I had recognized him officially and my name appears in his birth certificate.
His is about to complete 9 years in April, he is living with his mother in Nyon-Vaud, and It is clear that he and I need to be closer, he needs me to live near him and see him .

Can I apply for permit that allow me to live and work in Switzerland?

I think it will not be easy. Is the mother willing / can you afford to have the child sent to you for holidays?

The two roads to getting in to Switzerland are firstly to get a very good job (you will need a university degree and specialist skills) and secondly, if you have a very large sum of money to pay your own expenses.

What sort of contact have you had with the child before now? Why do you think it would make a difference if you were closer? Have you spoken to a psychologist or family/relationship therapist about the best paths ? What does the mother of your child think about the plan and do you have a positive relationship with her?

If she has full/sole custody over the child, the Swiss law may support her to limit or deny contact, so you need to be aware of your own limitations. If she is unwilling to bring the child to Venezuela to see you, then it is unlikely she will allow contact even if you lived right next door...

swisspea's right. I think you want to know if there's any sort of automatic right for you to live/work here because of your child. Well, the answer is no I'm afraid. You would need to either find a job here which is very difficult for a non-EU national or be wealthy enough that you could move here without the need to work. It is clear to who that you need to be closer? You? The mother? The child? How much contact have you had over the last 9 years? Or is it that you now see your son is growing up without you and don't like it?

Once you got the permit, if you get it, you still have to see and pay for the child. (pay is probably the most important of the two)

In last 9 years, you provided any child support ($$) because if not, you are unlikely to get a work/residence permit for Switzerland.

Thanks for your reply.

I know it is not easy, I have been there several times as visitor and omehow know how it is there. I have a university degree in IT with experience in ERP solutions, biometrics and networks.

The contact with my son have been since first 2 months of embaracy, by phone before birth and after birth, I visited him and stayed 12 days with him when he was 6 months old, and visited him again when he was 2 years old, and I am n contact with him by skype.

The difference that will make as being near of him, is that he will no longer feel that his father is away of him, as his mother told me that they note that he had difficulty of singing songs which mention father in it. And to teach, take care of him when his mother need to be away, as I did when I visited him. His pediatrician told us that the child needs more his father when he is older. His mother take good care of him and takes him to a psychologist especially cause he is away of his father.

But day after Venezula faced more conflicts, and it becames more difficult to travel outside, nowdays sometime you cannot find an airplane to travel outside, and very expensive airfares...

His mother and I dont have any paln to retyrn toghether, we concentrate for the good of our child, she have the full custody of him.

She is unwilling to bring the child to Venezuela because she knows about Venezuela that is one of the most violent lands, low security. I agree her in that, because he is getting better education there in CH, ethics and human respect.

I know her, and know her limitations, and know she want the best for our child too. she is limitating me to contact him by internet, but we managed that and contact with each other..

Thanks all whho posted here writting and concern of our situation.

One of main reasons I am willing to move to CH is to be able to pay for my sons spends, or part of them. because from Venezuela have been very limitated from transfering $ to outside, due to its economical situation. in past I have been able to send few $ monthly but the sistem cutted the way and I get not able to send more.

I have been since then being busy in submitting and applying to many international organizations for jobs in CH, not didnt get any reply.

So I started to ask for an official permit and then find a job easier.

Make sure you get copies of all bank transfers to the mother you have made, proof of contact etc. (photos, skype logins etc.), anything that is relevant to prove you've had contact over the last 9 years. That will make it easier to prove to the authorities you want to come to Switzerland for the "right" reasons.
