C Visa / B Visa, divorce, house, rental.

Hi all,

I have a somewhat complicated issue.

My ex who has a C-permit and myself who have a B-permit own a house "together", however we split up and would like to rent our house to subsidize our separate flat rentals. We will both still be staying in Switzerland indefinitely.

The house is in BL.

In my understanding, a b-visa person cannot rent their property, and this house is more or less legally entangled in C/B ownership. My visa should turn into a C visa in 18 months.

1. Is there any way for us to rent out the house legally, as we are still living in Switzerland afterward, but just don't need this big house individually, and also don't want to quick-sell it at a loss...

2. Do we just need to wait 18 month until I have a C visa, and then its just OK?

3. Can we/ should we start a company and transfer the house to that company? The company rents it out and transfers the money back to partners?

4. Will any of this force the bank to recall our mortgage?

I totally understand the need to restrict foreigners from buying property they don't live in - then renting it out, which would just drive the market through the roof, however, is there any legal flexibility since we will continue to be living in the neighborhood?

I've no idea, but if you're separated but not divorced then maybe you could continue to live in the house, even if too big, and pay her something as "rent" for it for the next 18 months. As you say a B permit holder has to live in their main residence, but how that works when the other half is a C holder I don't know.

Still, I would also be concerned about the C permit side for you. The Swiss authorities will expect you to be living with your wife and could ask why you're not. If your permit is dependent on hers being separated could cause problems for getting a C in the future.
