Marriage Question and Help Needed...

Hi all,

I've just found this blog after trying to do some research on marrying in a EU country.

I am a UK citizen and my fiancé is a Philippine national. We have been engaged for over 2 years. If no one is aware of the current immigration laws in the UK for trying to get a spouse/marriage visa, well, you need to be earning above £18,600 before you can apply for your fiancé to join you in the UK. unfortunately, for me and many others (married or unmarried), this financial threshold is out of our grasp because we don't quite earn that amount and it isn't easy trying to reach this mark in this country!

Question...

Does anyone know the rules and regulations for a EU member wanting to marry a non-EU member in the country of Switzerland? Is this possible? Do both parties need to be in the country to register if this is possible?

I have checked out a few sites but found nothing relating to my specific situation. Any info will be helpful e.g. links to websites, YouTube etc.

I look forward to reading your replies, if I get any!

Even if you got married in Switzerland... You'd still need to earn the £18,600 to then take your husband/wife back to the UK... so I don't really know what it would achieve!?

There is a route called the 'Surinder Singh' which is a way of bringing your non-EU spouse to the UK after 3 months of living and working in an EU country.

I understand what your saying. I forgot to mention that we would be looking at going for the route mentioned above. Here's a link to a page which explains the 'Surinder Singh' route to live in the UK.

It's possible. You'd have to come and live/work here then apply for your fiancé to join you. Be aware that Switzerland is not part of the EU, I don't know if it would be included in the Surinder Singh route.

Also to bring your fiancé/spouse to Switzerland you have to prove that you can support them, like in the UK. Unlike in the UK, Switzerland doesn't publish how much money you need to have!

As of 1st July 2013, The European Union (EU) is composed of 28 Member states: Austria, Belgium, Bulgaria, Croatia, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Republic of Ireland, Romania, Slovakia, Slovenia, Spain, Sweden, and the United Kingdom.

The EEA (European Economic Area) is an extention of this, which also includes Iceland, Liechtenstein, and Norway.

It is a common misconception that Switzerland is part of the EEA. This is not the case. Switzerland does, however, have a bilateral agreement to allow free movement of persons between Switzerland and the EU/EEA. It should also be noted, that the UK’s implementation of Directive 2004/38/EC (Immigration (EEA) Regulations 2006) has classed that Switzerland falls into the definition of European Economic Area in Section 2(1):

So, it looks like even though Switzerland isn't an EU or EEA country it is still possible to move to Switzerland and reside there just like it was an EU or EEA country!

Edit - You will probably need to move here and establish residency first, or at least know where you're going to live so you can contact the relevant cantonal authorities.

That's because Switzerland is one of the EFTA countries:

What are you wanting to do? Marry here and then go straight back to the UK or move here more or less permanently and get married here? If the latter then firstly you need to have/get a job here or be wealthy enough to get a residence permit without having to work. Then you'd also have to convince the Swiss authorities that you earn/have enough to support a wife as well. They will thoroughly investigate your relationship to make sure this isn't just a sham marriage to get your wife into the country and get a permit. The usual rough figure to work to is CHF100 per day for 1 person so you're talking needing around CHF36,500 for yourself (around £25,400) and then you'd need to add a bit more to cover the wife as well say, CHF50 a day which is another CHF18,000 (£12,500). So the Swiss authorities could be looking for you to have around CHF54,500 (£38,000) available.

Your bride to be will need a new birth certificate less than 6 months old, translated into one of the Swiss languages or English and apostled. She'll also need to apply for a Type D visa to be able to enter Switzerland long term legally.

There are no real "rules" when it comes to getting married here, you just need to provide a lot of documents. However, you need a residence permit and an income, what are you planning to do for work here?

I'm just in the preliminary phase of looking at potential EU countries to get married in and live/work there until we would be able to come back to the UK and settle here.

I'm not skilled in any particular field of work so any job would do! I'm just trying to get info from different sources. I'm looking at other EU/EEA countries also and what their marriage/work/living rules are.

I'm working here in the UK and my job is well paid for where I'm based but I only get paid when I work and this is leaving me a couple of grand shy of the £18.600 needed to apply for a spouse/marriage visa. Getting a second job would be difficult for a few reasons. A lot of the work that comes through in my job can be without little notice and I also travel all over the North of England sometimes doing over 1k miles per week opening up houses going for auction in London! Trying to squeeze in a second job in the evening isn't wise because it could put me in danger whilst driving the next day with lack of sleep and many miles to do! I couldn't replace this job for another one as I'd not get the wage I get currently as I was commended for this job I have by a friend and I'm way over the minimum hourly wage! Some weeks I could do 55 hours, other weeks 15 hours! It's very frustrating! What can I do!

I want to get married in the UK or EU and not the Philippines. I couldn't get work over there and I can't take my work with me if I was there! We know it's best to come here rather than there. I'm sure you've come across many in my situation! Anyway...

For un-skilled work, you would need to speak French, German or Italian.

If you don't have language skills, then looking at Ireland or Malta might be your best bet.

Although I understand what you are trying to do.

Switzerland is not the country to do it in. It is extremely expensive for you to hang out here for three-six months without work.

Your best bet is Ireland.

The suggestions of Ireland and Malta are good ones. The problem you'll find is not speaking another EU language will severely limit your employment possibilities in any EU/EFTA country. It's usually only the highly skilled/qualified positions where you can get away with only speaking English. Even work as a labourer, factory worker, restaurant, etc, will need a reasonable even if not fluent grasp of German/French/Italian here. Plus things like rental/employment contracts, car leasing, health insurance policies, will all be in a Swiss language - very few companies provide them in English so you would have little idea of what you're signing up for unless you can read them for yourself or have someone who could translate them for you.

Hi, I am in Switzerland doing the SS route at the moment. I didn't come here for that purpose however, I came because I got a job as a teacher in a school. I brought my non-eu spouse here easily and he got his 5 year family residence for Switzerland in no time, but I did have a job secured with contracts etc.

Switzerland is super expensive. Ever we, who are both working, are struggling, which made me to decide to look into the UK. Swiss people and the authorities are very efficient and if you have all the right docs they process your permits in no time. Me, a UK citizen took my permit in 3 days - AMAZING!
