Missed Visa Renewal Deadline

I am on a trainee/young professional visa. These are issued for 12 months but are renewable to a maximum of 18 months. Because it is associated with an L class permit, I assumed the renewal process would be the same (and fairly pro-forma). Turns out that I am wrong and that you need to submit a renewal application 2 months before the end of your 12 month visa.

I missed that deadline by 16 days... whoops. I know this is a long shot and I know the fault is all my own, but does anyone have experience/knowledge with these sorts of situations? Should I be prepped to move out on 01/06, when my 12 month visa expires? Is the renewal generally granted? Does the administration take a dim view of tardy applications?

For non-EU citizens like yourself, any process is far from "pro-forma", no matter what kind of permit they may have.

Has your employer applied for this visa or how did you get it? Generally, for the extension, the same rules apply as for the original permit. The 18 months simply refer to the maximum time on which you are allowed to be an L, but there is no general right attached to it, i.e. just because you had a permit for 12 months doesn't mean you'll automatically be entitled to one for 18 months.

Usually, while the permit extension application is being processed, you can stay in the country, but you need to have them confirm this in writing.

The most important bit about all this is, though, that there is no guarantee your permit will be extended. And if it is indeed not extended, you will have to leave after that 'grace period' between the expiry of your current permit and the official denial of an extended one has expired.

They won't care if an application is submitted too late - but they will not speed up the process because of that either and take as much time as they always do.

From where you came to know about 2 months deadline? May be it is 2 weeks.

If the renewal takes longer than 01/06, you might have to spend some time waiting for it and not working. As long the renewal application is being processed, you can stay. The two months is a recommended time frame, not a rule.

Usually the renewal application has to be made by the employer and not you.

I applied for the visa in the first place, as that is the required process "Section 4. Trainees are responsible for their own application." The original application was very straightforward. I sent it off while still in Australia and got approved within about 2 weeks.

I completely understand them not speeding up the process for my late application. I was just worried they might punish a late application in some way or reject it outright.

So I should get in touch with the office by writing to see if there is the 'grace' period while an application is being processed. Any other recommended steps?

Which is unusually fast 6-8 weeks is more the norm, maybe 4-6 for trainees

Since I understand you've sent the extension application yesterday, I'd give them a call maybe next week and ask to confirm in writing that you can stay here - and work! - as long as the permit is being processed. The work bit is important, it might be that they won't allow that.

Update:

So it turns out that I confused the Federal Office with my extension application, as I was issued an 18 month permit to begin with. I worked myself into a tizzy for no reason. C'est la vie. Thanks for the advice anyway
