Best Options for Swiss-American Couple wanting to move to the US

Hi All,

I am a US citizen (actually dual US & France/EU citizen) in love with a Swiss man. We have been doing the long distance thing for just over a year now and would like to be together here in the US.

We are trying to get information about our best options to be together quickly since we are in our late thirties and would like to settle down and start a family together which is quite hard when living on separate continents!

We both work for ourselves so unfortunately, a work or student visa is not an option. I've heard that a fiance visa can take 8-10 months for the US and we've already spent over a year apart and would like to be together as soon as possible.

My questions is whether there is any advantage to getting married in Switzerland or the US in terms of speeding up the process of him being able to legally reside in the US with me. He lives in Zurich (I don't know if that matters in terms of different laws by region) and I live in Massachusetts.

Short answer, I doubt it. The Swiss will look long and hard at your relationship before granting any fiancée visa for you so it will probably take just as long or longer.

If you have or can get a French passport you might be better to look into getting married there.

What do the Swiss have to do with it?

To OP, I haven't looked into this lately but many years ago (14), the quickest process was to get married in the US and then come back to the US Embassy in Switzerland and apply for the US visa there. Used to be about a 30 day wait for processing.

I know someone who did this recently but they were both resident in Switzerland. They chose the application for fiancé visa and then got married within 3 months of landing.

The whole process is not quick, trust me. 3-4 months before and 3-4 months after.

Why bother with a fiancé visa? Go on holiday to Vegas together and get married. Then he returns to Switzerland and applies to join you in the U.S. as your husband. You can have a proper wedding later!

I do not know anything about this professionally. But I know people who claim to know and they say the quickest way (assuming I read the question correctly) to bring a fiancé(e) to the USA is via a K-1 marriage visa, to get married in the USA and then adjust status. The spouse may not be able to leave until the visa is converted to a green card, I'm not sure. But there's lots and lots of discussion on this online.

I'm afraid it's a relatively long process whether you apply for a fiance (K-1) visa before getting married or a spousal immigrant visa afterwards. Where you get married doesn't matter particularly, except that you would apply for one kind of visa before marriage or the other kind after marriage. For that matter, he could marry you in the US either on a fiance visa or as a visitor. As noted above, if he entered the US as a visitor with the intention of marrying you, the appropriate thing would be for him then to return to Switzerland to commence the spousal visa application process, so there would be another long wait at that point.

However -- and I'm going to try to say this very carefully, as (like the rest of you on this board, I'm sure) I'm very much a proponent of things being done "the right way" -- if he were to enter the US for the purpose of a visit and, during the course of that visit, you and he were to decide that you wanted to get married and have him stay, he would be able to apply at that point to adjust his status to that of a permanent resident on the basis of his marriage to a US citizen. (He would have to remain in the US for a period of time during the initial processing stage of the application, but there would be no period of separation for the two of you.) It would not be appropriate, of course, for him to enter the country with an intention at odds with his category of admission (as a visitor) or, obviously, to misrepresent his intentions to an immigration officer, but it's entirely legal to adjust status under the circumstances outlined above, and it happens all the time.

I suppose if you wanted to do this by the book, you could wait until he is next on US soil and run this idea by him. Then there is no question as to what *his* intentions were when he entered the country!

If you look around the internet, you will see that there are people with strong feelings about the prolonged, expensive visa process being bypassed in this way (particularly among many of those who have been through the prolonged, expensive visa process), but it's a legitimate option that would at least be worth thinking about in your situation, I think ...

If you have a French passport you guys can probably get married in Zürich without a problem - if this makes paperwork easier it's worth considering, but the process itself isn't short.
