Non-EU moving cantons on B-permit

Dear English Forum members

I got some questions regarding moving cantons on a non-EU, B-permit.

I did research on this topic using the search function but could not find precise answers which is why I am asking for your help.

As mentioned I am a non-EU citizen on a B-permit (not tied to my employer) living in SG and possibly changing jobs and moving to Basel. So, as I understand from reading other threads, as far as I fulfill the requirements (new job contract, no criminal record etc) I should be allowed to move to the new canton. My questions is: Is this permit related to living in the new canton (i.e. renting an apartment for example) or is it a permit related to both working and living there? Can I start working for the new company and live in the old canton before the permit in the new canton is issued? I don't know how long the process takes to get this permission granted. This could be an issue if I have to wait for the permit and cant start working for the new company. This would essentially put me at risk of losing both jobs if my new employer gets impatient waiting for me.

The second question is related to the C-permit and the Swiss citizenship. Since coming to Switzerland I have 1 year on an L-permit and 3 full years on B. I am currently in my fourth year on B. It's my fifth year in Switzerland.
If I change cantons, does the time towards C-permit start from zero in the new canton?
And what about citizenship? Does the time towards the 12 years start from zero on all three levels (Bund, Kanton, Gemeinde) if I move to a new canton?

As far as I understand it with a B permit that isn't restricted to your employer you basically have the same rights as EU nationals and can live and work anywhere in Switzerland. Your permit will simply continue; all you need do is deregister from your gemeinde in St. Gallen and re-register at the new one in Basel once you move there. You'll be issued a new one by Basel migration office in due course.

As far as C permit goes, nothing changes - it's not affected by you moving, only whether you have spent the required number of years living in Switzerland and meet any other requirements of your new canton. Citizenship in another matter. It won't affect the Federal level, but will impact on both the canton and gemeinde which will start from zero again. Here's a list of the current cantonal requirements - you'd have to ask your new gemeinde what their requirements are.

Bear in mind that the law is changing in the relatively near future (late 2016/early 2017 at the moment). Non-EU nationals will be able apply for citizenship after 10 years providing they already have a C permit and the canton residency requirements are being standardised to between 2 and 5 years max. Whether the VINTA programme will continue once the new law is in effect I don't know, but I doubt it.

Sorry to hijack the thread but what are the requirements for getting a C permit for a non EU. Is it only the 10 year requirement or also language? Tried to find it on the citizenship page but was not clear.

For the C permit question, please use the search engine more thoroughly. It is quite clear in those discussions that the rules for C permits etc vary depending on canton and your country of origin.

For the B permit for Non-EU moving cantons, I am pretty sure you need permission to move cantons - so you need to speak to Basel, where you intend to live, before you begin the move from St Gallen. You will need the signed work contract from the new employer to sort it, I think....

It depends. Moving zug to Zurich, for example, I just had to notify after the move. Moving Zurich to zug, I had to seek permission six weeks in advance. Got my C a year later, would have been painless if I'd had it... But even with the B it wasn't hard, just a couple,formalities to go through.

Speak to the migrationsamt in Basel. They'll clue you in.

If you are in Zurich then it's also the language requirement as well as 10 years - unless you can qualify under the VINTA scheme after 8 years, but that also requires good integration and language skills.
