Can Non EU apply for Swiss work permit while working in EU

Hello All,

I am non-EU citizen & currently working in Hungary on Long term work permit.
I have been offered a new position by same employer in Switzerland.
So can I apply for Swiss work permit for 1 year from Hungary as I am non-EU member and my Hungarian permit is valid for 6 months from now.

Yes. Although your employer has to apply for you.

Your employer can apply for a work permit for you, you cannot as a non-EU person. Please note that Swiss and EU citizens have preference and your employer will have to proof that it cannot find anyone from CH or EU.

Your Hungarian permit does not count here unfortunately.

Check the forum and you will find a good amount of links with further information.

Thank you so much for quick reply.
That means I dont need to go back to my home country to initiate the swiss visa, that's great.
I read somewhere that since both the countries are coming under Schengen area, I need to travel back to my home town to apply for swiss visa and I can not work between this time in any schengen country.

yes, my Hungarian permit will not count for this but it should not create any problem since Hungary is coming under EU

No, as you are a resident of Hungary, you don't need to go back home. Your Hungarian permit may act in place of a D-visa (I'm not sure), or you can apply for a D-visa from Hungary if you need one.

Your status in Hungary has no bearing and will not make any difference to the permit application.

"I am a citizen of a non-EU/EFTA state in possession of an unlimited residence permit valid for an EU/EFTA state. Do I need visa to work in Switzerland?

Whether or not you possess a residence permit valid for an EU/EFTA state does not affect your status in Switzerland. You are subject to the same provisions on entry and work as people who enter Switzerland from a third state. As a rule, you will need to apply for an entry visa, which will be issued by the Swiss diplomatic representation abroad as soon as you have been granted a work permit."

You will need to apply for a Type D entry visa at the Swiss embassy/consulate in the country you're currently resident in which is Hungary.

Of course, you can keep working while you wait, why should you not? You may not get approved for the permit after all so why should you not keep working in Hungary.
