Non EU B Permit holder- Temporary work in EU Country issues A1?

Dearest EnglishForum,

I have been a regular reader of this fantastic website for help, and isn't it always the way that the first post is always for help sorry for that. I look forward to contributing and helping if or where I can

I am a Russian national working in Switzerland since 6 years and have a B permit (the non EU one year one). I work in the performing arts...(no it isn't what you think )

I have now been asked to perform for a week in a EU country festival and will receive a payment, but here is the problem (I have searched already on the forum for it ) Also this will also happen more often in future too.

The company have asked that I get an A1 form to show that I am paying Social Security benefits in the EU, or they will deduct about 40% of my payment to pay the fees in the country

The issue is that the taxation authorities say I cannot get an A1 form as I am not an EU National But noone has told me if I have an alternative way of producing a form that will stop me from paying the 40%

Does anyone have any experience in how I can overcome this issue?

The problem is your Swiss permit does not allow you to work in the EU, only in Switzerland.

There are probably regulations for artists that can get around this, but you may need to check with the Swiss tax office if there are social security agreements between Russia and Switzerland and/or Russia and the country you're going to perform in to find the right form. I tried Googling and while I could find a lot for EU nationals/AI form, I couldn't find anything regarding non-EU nationals.

You may also need to find out if the country you're going to has a similar registration system to this one for Switzerland:

That may get around the need for the form.

It seems I do not have the 'thank button'. but thank you so much for searching on my behalf it is really very kind that you take your time.

I understand I am in a position not often found by the Swiss people, but I just wanted to ask if there was any experience before I called the office and became quite confused

The solution, if any, will be specific to the particular EU state you are visiting.

All this is done by the same office that is in charge of the A1 document, they should be familiar with all the various agreements. If you were in contact with the right people and they were of no help, you may well be out of luck.

Thank you for your input.

After a lot of research I have finally received the official line on this matter from the BSV (Government Social Security office of Switzerland).

It seems the crux of the matter that I am a Non-EU national and that I am not being posted by my employer means that I am not legally covered by Swiss social security benefits in the EU country.

They DO have an agreement with the country, but it was for EU/Swiss nationals only.

I will therefore be required to pay SS and tax in the EU country.

Case closed.
