B Permit moving from Basel to Zürich and becoming self employed

Hi All,

I have searched through the archives and can't quite find anything with this situation. I have a couple of questions so I'll do a quick background and then ask the questions at the end.

My husband and I have lived in Basel on B Permits since March 2015 (we are EU nationals). He is based in Zürich with his job and I am based in Basel. I am leaving my job at the end of September, but his job is continuing and we will be moving to Zürich. I assume for this we will both keep our B permits (as we are married) and will just need to re-register in Zürich?

1) I want to be self employed from October, how do I go about registering in Zürich as self employed when I already have a B permit? What do I need to provide when registering as self employed?

2) Will we have any issues registering our B Permits in Zürich, and will being self employed have any effect on that?

1) You simply tell them. May need to present things like a business plan, financial situation, etc, as mentioned in the links. If they think it's a goer then you'll get your permit changed to self-employment. If they think it's not a viable idea/plan you won't be changed over and will not be able to work as a self-employed person.

Pardon me for stealing this thread, but I too have been trying to get an answer to a similar question. But I am a non-EU/EFTA b permit holder. My permit is linked to my husband's for family reunification, that is to say if his B permit is not renewed/valid neither is mine. But I do have authorisation to work and wonder how I go about applying to be self employed and start my own company and if it is possible/allowed? All that I read on the official website that you and others have linked to for non-EU citizens is regarding regulation regarding starting a business in Switzerland from abroad without already having a resident permit. I cannot find anything regarding what is possible if you are already residing in Switzerland with a B permit like mine?
Finally, I have looked on the OCP website (I am in Geneva), but I am not sure which department I should address my questions about this.

any thoughts are directions are very welcome please and thank you!

"Art. 46 Employment of spouses and children

The spouse and children of a Swiss national or of a person with a permanent residence permit or a residence permit (Art. 42-44) may work on a salaried or self-employed basis anywhere in Switzerland."

You'll still need to present a business plan, etc, for your endeavour.

However, I suspect you'll still be on a dependent's permit and if your husband loses the right to live/work here you'd probably have to close up shop and leave Switzerland with him. It may be possible to switch the permits around so he's your dependent and you the main permit holder, but it's judged very much on an individual basis and varies from canton to canton.

Check with the OCP migration office to be absolutely sure of what you need to do to set up as self-employed.

Ahhh heavenly instructions, thank you. I don't know why it was so hard to find that clause you sent but that is the knowledge I was seeking! In good time too as I just contacted the OCP.

Well, it's easier in the shortened English version of the Foreign Nationals Act I linked to. Finding it in the full 340 page French or German version takes a while.
