Extending a B permit for medical reasons? Unemployment benefits? (Non-EU)

Hi
I have one personal query. Do b permit will be extended on medical basis.?if yes then how many days??pls help me in this regard.

If you were an EU citizen, the answer would probably be yes. However, non-EU citizens who are unemployed do not have a legal right to have their B permits extended. In practice, however, if the person is receiving unemployment compensation, the B permit is generally extended although not legally required, according to the below:

"Nationals from third countries The first time, the B residence permit granted to a national from a third country is generally limited to one year. Normally, this authorization is renewable annually, as long as no reasons (infractions, social aid dependance, labor market) oppose it. However, the holders of B permits can not assert the right to the prolongation of the authorization.
Warning
The right to prolongation exists in certain specific cases.
  • Third country citizens married to a Swiss national,
  • The spouses and foreign children (until 21 years of age) of EU/EFTA national,
  • The spouses and minor foreign children having a C settlement permit, have, in principle, the right to prolong their B permits.
Warning
Prolonged unemployment can provoke the refusal of the renewal of a B permit. In practice, a yearly residence authorization is generally prolonged as long as the person can benefit from the indemnities of unemployment insurance. "

Thank u for the information.
But our work cintract end at november and we have doctor certificate stating not able to travel. So i asked this question.

Saturday night at 22.45 is possibly not the best time to get accurate information, even from EF. However, you could have a look at this which might put your mind at rest. There are always criteria to be fulfilled though. Things like giving up a job of your own free will will probably affect your rights and there is some sort of waiting period too I believe. Dig around this site a bit and maybe you can find the rest out for yourself.

I've merged your threads to keep relevant replies together. This sounds like a tricky situation. Among other requirements, in order to receive unemployment benefits the person must be actively searching and available for work.

I recommend starting with the local municipality. Ask them about the various scenarios and what you can do to stay here. They're involved in the permit process anyway and hopefully have some answers. Then review the requirements for unemployment benefits and see if you might qualify. If you do, then register with RAV and start job-hunting as soon as possible. Good luck!

It also depends on how long you did work in Switzerland- must be at least 12 months. Can you contact your Embassy to discuss this?

If you are on a limited time contract:

Obligations of an unemployed person

  • You are required to start looking for a new job while you are working out your notice period. If you are employed on a limited term contract, you are required to start looking for work three months before the employment is due to end. If you do not meet this obligation, your benefits may be trimmed.
  • Be sure to keep all documentation related to your job search, such as job offers, applications and rejection letters. You will need to present them to your RAV consultant.
