Change of Canton Before Residence Permit Issued

Hello Everyone,
First of all, I am non-eu, so I get to have the nice permit cards (which are also costly).
I registered to canton Aargau a few months ago, but I'm still waiting for my residence permit to be issued. In the mean time, I decided to move to canton Zurich. Which means, I should de-register here and register in Zurich.

Now that Christmas is approaching, I am a bit skeptical about my Christmas holiday back home. If I don't have a permit before Mid-December, I cannot really leave the country..

Should I not register to Zurich for a few more weeks and cross my fingers that I will get a permit from Aargau in the mean time? I think I have around 2 or 3 weeks to register when I move to a new place, but I am not sure how to proceed.

Don't think it is true. Once I was in similar situation (however moving within canton) and when I asked they told me that I can get a temporary visa stamped so that I can travel out of country. It might cost a bit.

For me however, permit was sent to old address, then resent to canton office of my new residence. I got it in time, so didn't had to apply for this special visa.

So the permit was sent straight to your house? I thought I would have to go to the immigration office to pick up the permit?

Not directly to house. It was sent to local canton office. They sent a letter to come there and personally pick it up.

For my friends in Zurich (who didn't change their residence), they got it in post (registered) and they had to personally pick it up after showing ID proof (passport).

Nice, thank you. I will look into this special visa. I hope it won't be very costly and does not take very long to get one..

Welcome!

Btw, I think first time permit will be sent directly. If it was returned back by post (since you no longer live in the registered address), they will send to local office. At least this is how it works in Zurich, not sure about Aargau.

Sorry, but this move isn't going to happen. Understand that as a non-EU national your permit is usually "tied" to your employer which means you HAVE to live in the same canton that your workplace is located in. If this is Aargau then that is where you must live. You can't simply decide to move to another canton as the residence restriction is part of the reason you're granted a permit in the first place.

Thanks Medea! Yes I actually heard this before, but I think some cantons have some sort of collaboration (I actually work in Zurich), so maybe they will even like it after all, but you gave me the idea to actually check this with the immigration office actually..

It can sometimes be possible to change, but both cantons have to agree. The reason why it's so difficult is that your "first" canton has spent time and money deciding whether to grant you a permit or not and they expect you to repay their generosity with your taxes (you're taxed where you live, not where you work). If you want to move then not only does the new canton have to agree, but also your old one who may not be happy about that idea.

You should not have registered in Aargau in the first place if your workplace is in Zurich. It's quite clear in the Foreign Nationals Act.

Art. 36 Place of residence

Persons with a short stay permit, a residence or a permanent residence permit are free to choose their place of residence within the canton that granted the permit.

Art. 37 Change of the place of residence to another canton

1 Persons with a short stay permit or a residence permit who would like to relocate their place of residence to another canton must apply for the appropriate permit from the new canton beforehand.

Zurich granted your permit therefore that's where you should be living and you shouldn't have been in Aargau at all.

Hmm, these are very eye-opening. Thank you very much. So I guess I should get in contact with both immigration offices and see what is and what is not possible!

Yes, you should because as your permit was granted by Zurich and you effectively haven't picked it up it may have been cancelled by now, I don't know. Your Type D entry visa is valid only for so long and whether your permit also has a set period after that for you to go and get it I don't know.
