Poursuites

Hi,
I had some trouble with a builder (don't we all at some time) we agreed a fixed cost of CHF21K for work to be carried out, I signed the quote stating it was a fixed price job. He carried out the work and then sent me an invoice for over CHF31K. I asked him to justify it and also to come back and fix an area that hadn't been completed satisfactorily. He didn't come back so I just paid in the CHF21K that I had agreed in the first place to pay him. This was back in 2012. I then got sent a letter from the offices des poursuits which I opposed. I now find that I have an ordinary poursuites in my name for the amount outstanding. It is dated March 2014. I have found out through the forums that this is likely to stay on my record for 5 years now, but what else can I expect from this? I don't think I have done anything wrong. Am I due to be taken to court at some point to enable me to give my side or will this simply disappear in March 2019? I have no intention of paying this. Also my permit B is due to expire next year and I do plan on staying and applying for a further permit - will this affect my application? I would really appreciate some advice on this. Many thanks.

Did the paper you signed state it was a fixed price job, or do you have any other evidence of that?

Can't you just send them a copy of the contract, a copy of the payment you made, and state that the builder is "mistaken" about the amount and ask for the case to be rejected / closed?

Then I assume it would go back to the builder to provide evidence that they are actually correct, which they don't have.

What I don't understand is that I have heard nothing about this since March 2014, it is only by mistake that I have found this out, because I needed an extract from the register of pursuits for a new job. Will this be taken further by the builder? I didn't realise I was expected to something further!

Yes I do, I have a copy of the quote that I have written on it the amount, fixed price and signed. I took a copy of it and gave the builder the original.
