B permit reception process

Hi

I have applied for the b permit and currently i am staying in the zurich . I will be leaving the zurich on 19 december,

So if i am not going the b permit before my travel back to india what should be the probable solution ?

If it's a holiday ask the migration office for a letter/document stating that your permit application is being processed.

Its not the renewal I am working for the company and my work permit is valid till 19 december so i have to go before that but one of my friend has his own company and he is offering the partnership in his company and thats why i will be getting the B permit to stay here
So my question is it possible to do something like this ?

Well, your new partner still has to prove he can't find a Swiss/EU national who could do what he wants to hire you for. Just becoming a partner in a business doesn't grant you residency rights or get around the non-EU hiring criteria.

I will going to buy the shares of his company . He is saying that its possible for non eu guys to have the b permit like this are u sure that this is not possible ?

Buying shares in a company, will not get you a permit. You still have to go through the non-Eu hiring process.

If you have applied for a permit though, you can usually remain in the country until you get a yes or a no! Ask you gemeinde/commune!

I am not sure about your situation but I am pretty sure that Swiss authorities have already thought sth to prevent these kind of shortcuts.

Exactly Tassadar. Buying shares in a company here will not grant you residency rights in Switzerland, that would be a far too easy way to get around the non-EU hiring rule. So that simply isn't going to work. If your friend wants to employ you he'll still have to prove to the Swiss authorities that he can't find a Swiss/EU national who could do the job.

It doesn't look like what you want to do is possible (ie. get a B permit through partnership), but for general information: assuming you *are* granted a B permit for whatever reason, if you're going to be out of the country but your application is approved and processing, then you need to apply for a visa to let you back in the country later. It's an extra 100CHF or so (at least in Zurich); I had to do it earlier this year since they always seem to take over a month to get my B permit renewed.

Hmm they didn't give me that option. But it could be because I had to go out of the country...

If you have a valid reason to stay and your permit is not ready while you want to go abroad you can go to Migration office (Berninaplatz) and ask for a reentry visa, you pay ~100 CHF and in 10min you get the visa.

yes, I used this service once
if your B permit in yearly renewal process and you need to make an urgent travel, only way is to get the reentry visa from migrationamt, berninastrasse zurich.
