Citizenship with spouse is naturalised Swiss citizen

Hello forum,

I've been looking on the internet for an answer to this question and haven't found it, so thought I would ask here.

I see that citizenship is facilitated and requires a 5 year Swiss residency for spouses of Swiss citizens who are born in Switzerland, but what about citizenship for spouses of naturalised Swiss citizens? Can a non-Swiss who has spent 12+ years in the country apply jointly for citizenship with a non-Swiss spouse who hasn't spent that same amount of time in Switzerland, and if so would the residency requirements for the spouse be ?

Were they naturalised before or after the marriage?

If after, then there is no facilitated naturalisation possible.

Where the Swiss citizen is born is not relevant. If anything I think you mean who are born Swiss.

But anyway, as Above, naturalized after the marriage then facilitated for the spouse is not possible.

Sneaky, but indeed an option. A divorce costs around CHF 3000 in court fees.

But if you look at the text of the law https://www.admin.ch/opc/en/classifi...index.html#a27 and interpret it liberaly

"The foreign spouse of a Swiss national who has lived in Switzerland for at least five years, has lived here for one year, and has lived in conjugal community with the Swiss spouse for three years."

You need only need to live with a Swiss spouse for three years. Nationality at time of marriage may be irrelevant. Means, you may be eligible for facilitated naturalisation three years after your spouse became a Swiss citizen.

Best ask this question the authority which is charge for facilitated naturalisation: the SEM State Secretariat for Migration https://www.sem.admin.ch/sem/en/home...s/kontakt.html . But better after your spuse became Swiss.

Sorry, but no. The spouse must be a Swiss citizen before the marriage takes place. From the FAQ section of SEM.

"I am a foreigner and married to a Swiss citizen. How can I apply for naturalisation?

You must have lived in a stable marriage with your spouse for at least three years, have lived in Switzerland for five years all in all, the last twelve months of which must be without interruption. If you live abroad, you must have lived in a stable marriage for at least six years and must have close connections with Switzerland. Regardless of where you live, you must be integrated in the Swiss way of life at least by analogy, comply with the Swiss rule of law, and you must not endanger Switzerland’s internal or external security.

Note:
The Swiss spouse must have been of Swiss citizenship before marriage."

Then it is divorce court and remarry 2 months later.
With the risk that your ex-spouse may remain your ex-spouse forever.
