EU citizen living in Switzerland, working in EU - can spouse work in Switzerland

Hi all,

having a few difficulties with the timing of my hubby's new start in Switzerland and a need for me to have a work permit in my hand before my new employer will offer me a job.

I am non EU, hubby is EU.

Assuming we made the move to Switzerland and he was still full-time employed in Austria but registered as resident in Switzerland, he should be considered an economically active Grenzgänger. As I understand it, since he is both economically active and resident in Switzerland, I should get the right to work in Switzerland. But I can't find any information on this anywhere. Would I be issued a G permit with the right to work in Switzerland if we did it this way for the time being?

We had the opposite situation when we were both resident in Germany and he worked in Switzerland, and in that situation I was given a work permit for Germany...so I believe from a legal perspective, I should have the right under EU law but I am wondering about the reality of this working in Switzerland...

Anyone have any idea / experience with this? If we can do this, I would be over the moon because this timing issue is getting in the way of a fantastic job opportunity for me

I think I found my answer to this myself in this document for EU nationals Switzerland

EU nationals living in Switzerland while working in other EU countries are considered economically inactive.

Sigh..

If you live in Switzerland you never get a G permit. G permits are for people living outside but working inside of Switzerland. G permits are extremely difficult for nonEUs to get even if married to an EU citizen.

I'm afraid you are not going to get around the fact that your husband needs to move here first, with employment of some sort. You cannot be the one that's employed first.

Thanks, yeah it's frustrating but I'm sure one way or another something will work out in the end.

My husband would be employed before me but because my future employers need me to have a permit now (2 months in advance of start date) and he won't actually be there for another month, it's working out a bit awkward. It seems I'll have to just be patient and hope my job is still available in a month
