dear all,
I am algerian living in london but my daughter is italian but born in ticino region and she live with her mum in lugano and they hold b-permit and I want to know if I can joint my daughter?
First question: I am non-EU living in london UK and my daughter is nearly 4 yrs and I want to move to live near my daughter in lugano.Can anyone tell what are my chance or what are the procedure?
Second question: Is my daughter can have a swiss nationality because she is born in ticino switzerland?
thirds question: If my daughter is swiss for me to move to swizerland is it going to be easy when I apply for a work permit to joint my family even I am not with her mum?

I m no expert but I think I can answer ur question number 2 &3 
Your daughter can't be swiss at the moment even if she was born in Switzerland. Her nationality can only be the same as urs,or her mums.

You should go see the nearest Swiss consulate or embassy. They are the only people who can tell you with any authority.

I am Algerian citizens living in the UK since a while now but unfortunatly I can't see my daughter who is 5 years and she is Italian citizen with her mum who is italian too and they hold work permit B and her mum is working in lugano (Ticino) and that's because I am still waiting since 3 years to be granted my Indefinite leave to remain in UK ( Mybe positive mybe negative) by the Home Office.
My question is: If I want to apply to join to settle with my daughter in swizerland what are my chance ( Please bear in mind me and her mum we are not together and we are not going to get married ) ???????.
Please help I didn't see my daughter since a longtime her mum brought her to see me only once in the UK also my daughter born in mendrisso lugano and she is registred in switzerland and in her birth certificate they is my name as her dad but she hold work permit B only because of her mum.
NB: I meet her mum 6 years ago at university in london. I speak italian, arabic, french, english also I have a master science in Information Technology.

At least I provided an answer.
And if you want to see the reasoning behind it here goes: the immigration law only allows for family reunions when the spouses are currently sharing the same domicile, and also a strong functioning relationship such as marriage or partnership can be readily demonstrated.
Further, a permit could be delivered in cases of extreme hardship such as mother passing away and there'd be less disruption for the child to be kept here and allowing the father to take care of it as opposed to sending the child to live with the father on an uncertain status in the UK.

Article 8 is supposed to protect that but it's full of exceptions and the conditions which need to be met are strict. From what I know about it, people have been more successful invoking article 8 to prevent deportation breaking up an existing family relationship (you are living together as a family and you provide financial support), as opposed to allow the right to immigrate to establish a family life which otherwise doesn't exist.

As you are not intending to live with your daughter's mother, but are considering moving from away UK where you have a 'Permit' still pending, have you ever considered, with your qualifications and languages, living in northern Italy? The actual domicile may not be all that important. Even if you were to live in Lugano, you are not really 'joining' your daughter. Being nearer would, however, mean it would be cheaper and quicker to visit. I have no idea what the job situation is in N. Italy, but it would perhaps be easier to get permission to live there, rather than in Switzerland.

I suppose the DAD has not right in this world ???  .
And the SWISS and others EEC member if you are the DAD of a child you have to paye maintenance.I have being contacted by the swiss child benefit to pay maintenance for my child and I said to them where is my right to see my daughter????. Who will give me my right toable me to move to see my daughter ????.
I was asking myself is that justice equality between man and women????.
Who will see how i feel because me too I was to give affection and love to my daughter and I am sure the child has all right in this world to be with his mum and DAD also???

maintenance and access rights are two completely different and unrelated issues.
As a dad who is divorced from the mother of the child and the mother has sole custody means that you have little support in this situation. If you had sole custody then the mother would be the one SOL.
It's an imperfect world.
And if it was so important, howcome you've taken 18 months off from this quest?
