EU gay couple - permit for partner?

firstly thanks for this great forum!
simple ( I hope) question. I have been offered a job in Switzerland - moving over from London. Any tips or advice on getting a resident and work permit for my partner of 10 years. Would it be easier for us to get a civil partnership here in UK first? anyone else been in the similar situation? looking on this is seems same sex partners are treated the same in Switzerland as long as you can prove you have been together more than 5 years? help and thoughts really appreciated.

Re: EU gay couple - permit for partner?

hi there, my best friends brother is gay, he and his partner registered as a civil union s he could come and work here. it was the only way he was allowed to stay in switzerland. registered couples get the same rights as married couples (as far as i know). but don't know if this is a different situation as he is swiss. his partner is from the us. hope everything goes well for you!

Re: EU gay couple - permit for partner?

Hi,

The process of getting a permit here for an EU citizen is much easier, practically everyone gets one at the moment.

However, to lesson the amount of paperwork in your situation, it would be easier to register in the UK, and when applying for your permit you apply as a married couple.

Re: EU gay couple - permit for partner?

Hi ricardos,

We are a gay couple moved to Lausanne almost 2 years ago from Denmark. As mentioned by others your partner should not have any problems obtaining a work permit as an EU citizen. You might consider registering your partnership to ensure your legal rights as next of kin to each other - however, our experience is that it does not make the paper work less complicated since the authorities here are still not really used to registered same sex partnerships.

Wish you both good luck here - it's a great place!

Re: EU gay couple - permit for partner?

Hi everyone,

I am French and my partner is from the US. I currently work in Geneva and I am trying to figure out the best way for him to come and join me here.

If we were to get a Swiss civil partnership, would he be given any rights? I know that when one of the two is a Swiss citizen it works. But none of us are.

If you have any idea on the best solution - or simply a solution - to make this happen, that would be amazing. Thanks a lot.

Best!

Don't forget to get a German/French/Italian (delete as applicable) translation of your marriage/civil union documentation.

But as I am French and not Swiss, would the same sex civil partnership give him any rights to come to Geneva?

Re: EU gay couple - permit for partner?

Be careful with the PACS, it's not considered equal to Partnership laws in northern countries (I am sure for Germany, not for Switzerland). Geneva Canton had a kind of Pacs of their own, so ask the authorities directly, or go to Dialogay.

It's always possible for you both to live on the French side and you work in Geneva anyway. The issue there is that the Pacs in itself does not give the right for a foreign partner to live in France, it's only "un élément d'appréciation" in the process. At the end of the day, it's a financial question. If you two can pay for yourself, the rest is just paperwork. Last word of caution: they often lie in French administration and usually have no idea about pacs (and won't ever admit it), so double-check every single piece of information you get and always write down the name of people you talk to.
