With Schengan Visa - Entered Swiss by road - Urgent information needed

Dear all,

My uncle is an NON EU came for europe tour organised by an agent.
He has schengan visa and UK visa , and he visited UK,netherlands and France.

From france he came to swiss with his group by Van ( ie by road transport).No one checked the passport in border.Now all his tour mates left to france by TGV train.In the train authorities question about entrance into swiss with schengan visa and warned them for their act.
From france all of them left back to London by air.

But my uncle didnt went with them as he want to stay with me for few days and he booked air ticket to london from zurich.

Now my question is

Would there be a problem in zurich airport with his schengan visa ?

If it is the case, what he should do now?

From your nationality, I would presume that your uncle is an Indian national. Switzerland is as of yet, not a schengen member state.

As far as i know Indian nationals require a visa to enter Switzerland as a tourist. I would think that there would definitely be problems at the airport and he would not be allowed entry.

I would also think that taking a chance at a road border crossing is pushing the limits of luck. Of course you may not be checked but chances are he will be and if you are caught trying to illegally enter the country the consequences for future trips to Switzerland could be dire. As in the case you outlined, the friends were caught leaving Switzerland not entering.

"What should he do now?" ... cancel the ticket and go the legal (and safe) route to visit you.

If I understand you correctly, your uncle will be leaving Switzerland.

He should have had a visa but I can't see that they will not let him leave, they will probably give him a hard time but they'll let him leave

I think he should take a train or in best case a car back to Germany or any other Schengen country and then fly from there..they will let him go from Zürich airport but his records will be kept as someone who entered the country illegally..They hardly check that if you are leaving by train/car..so that would be the best bet I reckon.

no! there is absolutely no need to worry if you have a schengen visa! i know an Indian friend of mine who visited from France with just a schengen visa and it was a flight. I also know of other asian friends who come from austria with just a schengen visa to fly out of zurich because its the closest airport. so, dont worry!

The fact remains that Switzerland is not part of Schengen until 5.12.2008 at the earliest and every leniency is inofficial or hearsay.

true. and i know for a fact that with a schengen there is absolutely no problem flying in/out of Switzerland even if you are non-EU (and not from US, Canada, Japan etc. passports with which you can anyways travel everywhere). however a non-EU( and not from one of the above countries) with a Swiss permit you cant go to Germany or other schengen states without a schengen visa.

Are the Swiss authorities entitled to endorse his passport as having entered illegally upon exit, which may cause him problems when re-entering the UK?

Let's hope he gets a sympathetic immigration officer on exit.

i hope this one will help... i'm not sure if you really have to do this or not... but i guess the best thing to do is to send someone in the UFFICIO DI STRANIERI (OFFICE FOR STRANGERS)... and from there you should inquire what are the things u must do for ur uncle... but for the mean time better cancel his flight and wait untill you will have some informations... and don't make him risk crossing the border in any kind of transportation... that's all i can share...

Didn't see any info regarding Schengan visa and Switzerland. Basically, even though CH is not yet accepting Schengan visa in general, citizens of certian nations are permited to enter CH legally with only a Schengan visa and not a Swiss visa. Here is the information:

Schengen visa
The Schengen visa is not valid for Switzerland .
Exeptions: Citizens of Bahrain, Kuwait, Oman, Qatar, Taiwan, Thailand, Saudi Arabia and the UAE can enter Switzerland with a valid multiple entry Schengen visa.

I am thinking maybe this is why some ppl have posted answers and experiences that implied a Schengan visa may be used to enter the country. But India is not on the list.... so, take your own risk when leaving the airport from Zurich. He should be allowed to leave, but whether he will be caught and left with a bad records or not is partially dependent on luck, as I am afraid.

Well,

What is done cannot be undone. It is simple that they will not stop him from leaving at the airport or road/train border and will give him a lot of **** and if by any chance they do stamp his passport for illegally entering in Swiss - and inform the ministry at India or the airlines carrying him back to India - forget future Visa's and a lot of nice police guys will be waiting for him at the airport in India wherever he is landing as it is then considered as a illegal immigrant trying to sneak in Swiss and put under deportition laws.

How I know this?? Well 1st I am Indian by birth and 2nd I have worked as an immigration officer earlier in life and have handled a lot of cases like this but I know for sure a lot of laws have changed since I left my job so maybe he just get aways with it.

Also by the way schengen Visa is not valid for U.K either -Does he have a british passport?? or a U.K non working 6 months Visa.

That is true but misleading, the "Schengen visa" that is valid in Switzerland is NOT the tourist visa, it's the residence visa which is the equivalent of a residence permit. I highly doubt that the person mentioned in the OP has a residence permit in an EU country.
