Getting married and changin job..

Hi all!!

I have already been living in Zurich with non EU B permit and on 12th of May I am getting married with a Swiss. My current B permit was granted by migrationsamt for the specific project I am currently working on in my company however I was told that these boundries for limiting my job rights in Switzerland will be removed automatically after getting married. Is this true??

I am trying to find this out because I have received a better job offer but I need to free my self from my current work permit limits in order to accept the new offer. Will marriage will remove these limits?

Also, initially it took me like 1 month to get my work permit and another + 2 months to get my Ausweis. If I get married on the 12th of May, do i need to wait again another 3 months until i can make my transfer to the new job and get a new ausweis?

Anyone with similar experience??

Hi, I got married last year and this is certainly what my husband thinks - although I now have my new foreigners permit and I can't see anything on it that restricts job options, I'm not really sure what it said before.

Not sure about the whole job thing but don't expect the new permit immediately! We got married in the UK, then had to send the papers etc to the swiss embassy in london... who sent them to some place in switzerland...who sent them to the immigration people... who sent them to my husband's place of origin...who sent them on to the gemeinde. Oh and despite changing my name to my husband's (and having to write separately to each of these institutions to confirm this) they still managed to produce my permit with the wrong name on it. I just ignored it, but they noticed when we moved house and had to re-issue it with my new name.

In short, just put on your job application form '(will be) married to a swiss' and that'll probably be enough!

ok but considering that I dont have to make this all through an embassy abroad or something since I am already living in Switzerland, it should be much faster for me to go through all this. My new employer is aware of my marriage and they are supporting me in this process. I am just not so sure how long would it take to convert my current work permit (which limits me to work for my current company only) to an unlimited one after marriage so that I can be transferred to my new employer.

My question is rather related to work permit and work permit conditions but not residence permit since I already have rights to stay here. My only doubt is about changing job and how fast can I make this transfer so that I can calculate the exact time to notice my current employer about my resignition.

Hi,this is basically how it goes,

You get married,your work permit will remain an 'auslander ausweis B '.
That stays that way for five years,then it will change to an auslander ausweis C', which means you are basically a swiss citizen other than you have no political rights etc.
The B permit means you still have
to pay every year for a new permit.
The C permit means you pay every five years for a new permit.

With the B permit you are not supposed to really chaange your job, without prior permission from your employer or the fremdenpolizei.

The C permit means roughly you have free movement and choice of employment,when you want.

Changing names etc. is normally done at the einwohnerkontrolle at the local gemeinde.

Changing your job,you are supposed to give at least three months notice depending upon your contract of employment,and they are very strict here about that.
As I said before you are supposed to ask permission from your present employer to leave for another job,when you have a B permit.
If you have been offered another job, or better, it would be wise to check with the local fremdenpolizei.
Being married to a swiss does not alter anything, it only means you can bend and twist the rules a bit in your favour.
So it is better to play safe with your present boss, it could be that he is understanding, maybe not.
I would personally explain the situationto him, and see what he has to say.
Any way there is more than one way to skin a rabbit

Do you mean that, even though I am married to a swiss, i can not change employer if my current employer doesnt allow me to?

All I know is that, my current employer got me to switzerland with a 36 months work permit granted to me provided that I work on a specific project that my current employer has. Therefore, I could not change jobs becuase Amt für Arbeit did not allow me to ask for a new work permit until the 36 months is over.

However, we consulted them regarding the marriage and they said that marriage would lift off the limits on my work permit since my allowence in switzerland becomes my spause but not the project im working on. Is Fremdenpolizei the Amt für Arbeit?? or something else?

I am not interested in B permit, pass or C permit whatever issues.. what matters is that I should make this transfer to my new employer. I just wanna make sure its done without any flaws.

I think you will find the B permit is 'employer driven'. ie. a new employer applies and pays for their part of the permit - and are named in the permit. Now you are married to a Swiss, you can stay here forever (as long as you pay for your permits and taxes). You can also change your job provided you find a new employer.

It was a complex and confused situation when I went through this 18 years ago - and it sounds as if not much has changed...
