This is normally straight forward, are you an employee of a corporate legal entity that provides the financing etc. and are the documents associated with the trading activities in the name of the company, if so then the company if responsible for the trading and you are just an employee. If not then you are the trader and are liable for all associated risks - which is not a good thing if you are publishing investment advice.
