Hi all,
I'm a Greek and working in italian's restuarant, but my boss sold his business 3 months ago for retired. The new boss not hired me again. So I'm unemployed now, I'm looking for a new job but it's difficultly. I'm a permit B holder and expire in 12/2013. Do I need to leave at once or I can stay here looking for a new job? can anyone same as me, please give me some advice please! Because I'm really worry about that I'm not get a new job for a short period. I'll appreciate that, thanks!

You're allowed to stay and look for a new job.
You should register at the RAV office asap to collect benefits.

No, you have an EU B permit that's still valid - you don't need to leave. If you've worked at least 12 months in the last 24 months you should qualify for unemployment benefit. I see you're in the italian part of switzerland, so you'll need to visit the local URC (RAV in the italian part) office. They'll help you find work, and they'll arrange for benefits to be paid as long as you qualify for them.

Thanks for your help! I'll go to there and hope to get a new job. But I don't want get any benefit of government because my friend told me don't take any benefit. It had the record there and I don't like that. ( I'm not oldman and I have my ability too ) I'll do some small job and earning a few money at first. I believe I can get a new job if I don't need to leave here. Thanks again!

You shouldn't feel guilty about taking unemployment benefits if you're looking for a new job. Anyways, they will explain everything when you register.

While your stand is admirable, you should realize that this is not some kind of government hand out! During the period you were employed, an amount was deducted from your salary each month as an insurance against the day you might find yourself unemployed. This day has come and now all you are doing is claiming what you paid for, like everyone else.
There is no stigma associated with claiming unemployment benefits and in fact most new employers will assume that you have been doing this if you have been out of work for a while, as it is the normal thing people do.
The benefits will also ensure that you have sufficient cash while you look for a new position.

Sandro, you were made redundant through no fault of your own. It's important you realise that RAV benefits are not to do with you being unable to find work in the long term - it's just some money so you can pay the bills while you look for a new job! Go to the RAV, they'll be happy to help.

If your boss sold the company but the new owner will be carrying on the same business (restaurant), then this is called "transfer of enterprise" and all employment contracts will be transferred to the new owner of the company (see swiss code of obligations art 333 and following) so the position of the new owner might not be totally correct, depending on what the "does not hire me" means.

I know that because my boss is a honest guy, he told us aboout the law. But the course is they change the restaurant to sold their homemake cakes / some snack and drinks only. So they don't need anyone in kitchen, but they carry on all waiteress again.
My boss is a nice man, he apologise to us and he got a good offer. So he gave me more 2 salaries and another colleagues 4( they are worked to there over 5 years) This not his fault because he is 68 years old, and want to more time with his family only! We are support him! 
And my friend introduces a job to me early but I need waiting for about 2 months.(waiting the guy finished his contract and go away) I worry about that if I havn't a long term job about 6 months, do I need leave here? but your reply make me relaxing!
