| | | Issues with a 2nd hand car with optional warranty
I just bought a 6 year old car 2 months ago, with an optional 12 month warranty, for which i paid CHF 550 extra.
2 weeks later, a LED went on, that there was an Issue with ABS and Stabiliser System. I contacted the Dealer where I bought it, and they told me to take it to any GM/Opel Garage and have it repaired there under the Warranty. I made an Appointment to drop the car off just before christmas, and pick it up afterwards. Additionally, I noticed, the Passenger Side Electrical Windoiws was not funcional.
Now, the Garage has phoned me up, and said, that because the car did not have all services, the Insurance may not cover, and asked me, if I could find out, if it had a service, that was not recorded, wanted it repaired anyway, before they send it in, as there was a risk, the insurance may reject it.
Also they made me aware, that the car had taken water in in the back, and asked me, if I wanted them to investigate it. Immediately, they said, that this would definitely not be covered by the insurance.
From the Brochure with the Insurance offer, water intake is not mentioned as covered by the 12 month warranty, and when I contacted the car salesman by email, he replied, that it is not covered, and I should ensure, the windows in the back were closed.
1) What is my situation with the Insurance, if the Garage is right, and they dont pay ? Can I hold the car salesman responsible for either the repair, or for a refund for a potentially useless insurance, that he should not have sold me in the first place ?
2) When the Water Issue was brought to my attention, I had been away for christmas for 10 days. I have not seen it myself at the moment, but the car has electric windows, and I never let the button to close the windows loose before i hear the engine stop, so I very much doubt, that it is caused by an open window. When I had 1 semester of german law many years ago, I remember a term called "Nachbesserungsrecht". Does this also exist here in Switzerland ? And how do I proceed, when the seller just replies "make sure you closed the windows" without even asking to see the car ?

Do you have legal insurance? The car should function correctly at the point of sale, that is a basic law.
Are you a TCS member? They can help you.
Do you have a subscription to K-Tpp or Beobachter? They can help you.
But I suspect these guarentees are not worth very much.

I would speak to the warranty company and make sure. Theoretically, if the car was serviced correctly, and you have not needed to have a service (and missed it) since - then the car's state and condition was agreed upon by the warranty company and the time of purchase - missing services or not.
I would suggest not pursuing any further repairs until you clarify with the warranty company
