I also asked around in the office, my options are

1) I should go and ask to Stadt Polizei, see if they advise anything on that.
2) Try to negotiate with the guy, what ever I can bite off
3) Pay the bill, then fuel up with whiskey and smoke to forget about it. Lesson learned, never ever do that again.

Right now I'd go for option 1), let's see if I end up with option 3)

If option 1) isn't helpful, I would call up the company who issued the fine and tell them that they have issued an illegal fine, which is an offence. If they do not cease and desist with payment demands, you will involve lawyers.

I guess for what they thought was an easy quick-win, they won't want to get involved in the hassle of legal fees and will probably drop it.

This is not a fine at all, but "just" the bill for the requested Abschleppdienst, but you left already before they arrived. Nevertheless, the service was already requested and has to be paid. So, IMO, it is fully in line with the law.

Well as you mentioned before Stadtpolizei was not very useful, gave me yhe phone number of the Police Tow-Car dept. to check their prices. He was not sure but more in opinion with i should pay at least parking fee up to 200 chf. Well it became lesson learned for me, i will try to talk with company again, but pufff...

First of all: You caused the whole thing by parking illegally on private ground where it was clearly statet that you shouldn't park there. Maybe there is a reason why they had to put a sign there. I had my fair share of the "only 10 minute parkers", usually it was much longer and after the 10th car blocking the parking for real customers it gets annoying.

So I find it ok you have to go through the hassle even if the invoice is not justified. Be assured that if you don't pay the invoice that the land owner will report you to the police as they have all evidence needed. Maybe this will be a bit cheaper for you.

A mate of mine actually had his car towed from the front of an office while he was at the gym. It happened later in an evening one night during the week. He caught a taxi straight to the towing company and told them what they had done was illegal and he wanted his car back immediately. They pushed back and were essentially holding his car to ransom until he payed.

He refused and then called the police, the towing company called their lawyer who also came down. It turned into a stand off and in the end my mate won and the police told the towing company to give him his car back. It took him 2-3 hours and a lot of drama but he got it back without paying a cent. It seems these towing companies are not legally allowed to do this and if you push back they have to fold and give the car back.

While he was there, 2 or 3 other people rocked up to get their cars back and paid the fines without even blinking. Seems like they pray on people's desperation to get their cars back ASAP.

Not the same situation as yours but it might be worth calling their bluff and refusing to pay. Or at least getting further solid advice on where you stand before paying the fine or any amount at all.

i totally agree what you say above, but since My car was not towed i thought it was a side dish for these guys. The only evidence they found is camera surveillance footage, which clearly showed i was there and i left.. Anyways i will try my chances with the company

And that's why you take your plates off the publicly accessible registry. If they had to go through a hassle to get the money, I doubt they would do it.

In any case, if it's not a fine but an invoice for a service that you didn't order or receive call them and tell them to stuff it.

The guy that called the tow can come request it legally from you if they want. Till then tell them to f-off.


Also professor taratonga, take a chill pill, will ya? The guy stopped on the parking of a closed shop for 10 minutes and left without a hassle. Someone is taking a monumental piss here, and being sanctimonious and righteous isn't helping anybody.


470CHF for 10 minutes in the wrong spot is absolute BS.


PS I bet that if the OP pays the 200CHF they will ask the rest in admin fees anyway. What a load of bollocks, everybody's invoicing everybody whatever the f they can think off, and nobody does anything about it because they can afford it and don't care enough, or for fear of escalation. This country some times fails spectacularly...

I'd be wary of paying a fine with a spelling mistake on the invoice. There is free or very cheap legal advice in most Gemiende, perhaps you could check yours out.

To be clear here. There is some kind of towing mafia around who did some really fishy stuff in the past (especially in Zürich around Escher-Wyss-Platz).

1. You don't have to pay the invoice as you didn't call them. The land owner himself can send you an invoice but there is usually nothing they can do if you don't pay (maybe if there was an emergency etc.). They would have to take you to court but will lose most of the times in such cases (again this may vary if there was a documented emergency).

2. The land owner can report you and you will most probably get fined.
The land owner will not see any money.

3. The land owner can take you to court for his expenses. If he had such. Federal Court only protects such expenses up to CHF 100. Most probably this is not worth the hassle for them.

4. Most probably the Towing Company acts independently but in agreement with the land owner. Easy money as they seem to check 24/7.

5. The police will not get involved as this happened on private ground and is a private dispute.

My take on it: Rather pay CHF 200 + some court charges into the community chest then CHF 470 into some filthy private pocket.
