Parking Ticket for 470 chf !!!!

2 weeks ago, on a quite Sunday morning, I stopped by a backerei for 10 min with my car to pick up some breakfast, and drove back home immediately. Couple of days later I received this god damn bill total worth of 470 chf with my car picture taken from security camera!!
300 chf for wrong parking, 50 chf for weekend surcharge and 120 chf for admin costs.

I went there again, I saw a sign for no parking which indicates penalties up to 200 chf by police decision dated back in 1966 etc...

I tried to reach out these Tow-Car company, they told me that they will give me a call. What shall I do? Any advise, other than paying the bill directly??

Go back and copy the exact inscription on the sign. It states a maximum Fr 200,- and the name of the Judge.
Then write to the judge asking for his decision on the level of a fine for a 10 minute parking dispute.

It says up to 200 chf (Bis 200 chf) !

Someone else recomended me to go to Police Station to find out if they have an official right to collect this money ?

Well I'm really confused...

Then I would go and do that then. If it's a tow company, why didn't they tow you, rather than sending you a bill?

I am confused. Why did you reach out to a tow car company? You car hasn't been towed, right, as you said you drove back home?

It sounds an awful lot for a simple parking fine, but then again you are in Switzerland!

Ok, here is the short form: Where exactly did you park, was it by chance a private property?

Some landlords let private security contractors hand out fines on their behalf. This is in no way an official parking ticket, even if it looks like it... you should pay it if there was a sign with a fine stated and a judge... however: 470 is clearly a rip off - this lawyer at SRF recommends to pay up to 100.

Do you have legal insurance? If yes ask them. If not: i don't think having a chat with the local cops will hurt - I am sure theyd be curious to know about somebody handing out fines that high...

Since I was there only for 10 minutes, this private Tow-Car company could not catch me up, then they sent the bill to my home address.

Probably the parking lot is either online-monitored or owner/neighbour called the Tow-Car company up.

It is a clear rip-off. Unfortunately I dont have any legal advise insurance, now I see how important it is to have one.

It smells fishy, it could be that Tow-Car company and the owner are sharing the profit from the Parking Lot. By the way, it is an Asian Market/Restaurant called Lian Hua on Schaufferstrasse 269. The frustrating thing was Lian Hua is closed on Sundays, that I thoguht

I will go to Stadt Polizei, I dont know if they can help, but at least advise me what to do.

The sign for the parking in front of my building states "up to 2000 chf" (yes, two thousand). I saw someone get fined once and I looked at the paper, it was 80chf, but still

Unless you do something really stupid like blocking an emergency exit is it not allowed to simply tow you away if you park on some private parking space. In the worst case is the owner allowed to send you a bill for his costs (for about 30-40 CHF).

He comes to the scene, he sees no car, gets pissed off that he would not make 650 chf to tow the car, then comes up with an above mentioned idea.

The thing is I'm also scared not to be on the debt-register (Betreibungsregister) which would kill my future in Switzerland since I am already in CH for 7 good years, without a single fine or crime.

That's how they make money I guess... long story short: it's not legal to tow you. It's not legal to charge more than 30-40 CHF on top of a fine which needs to be clearly put on a sign for "Umtriebe" - the effort of the contractor. Weekend surcharge is illegal as well. So if the sign says 200 CHF can they not ask for more than 240 but even that is highly questionable.

If you don't pay will they send a Betreibung and then it goes into a civil process where it will be settled how much you have to pay. You will only get an entry in the register in the end and only if you are in the wrong...

I'm not 100% sure but I think I read in previous threads that this bill would be payable by the one who ordered the service as it is private property.

For a fine this size I would consider seeking legal advise. There should be a pretty clear answer as to whom has to pay this fine and/or if the tow car company is allowed to write out these kind of fines.

it would probably be much cheaper to pay the invoice than pay the lawyer

Does that mean that in CH you simply have to suck up and pay every invoice you receive, rightfully or not?

That mentality is just wrong. (but I get where it comes from reward/riskwise...)

well isnt it a bit weird that thinking of hiring a lawyer is also scarey?? :P
Smt wrong in this country? :P

I also asked around in the office, my options are

1) I should go and ask to Stadt Polizei, see if they advise anything on that.
2) Try to negotiate with the guy, what ever I can bite off
3) Pay the bill, then fuel up with whiskey and smoke to forget about it. Lesson learned, never ever do that again.

Right now I'd go for option 1), let's see if I end up with option 3)
