Running red light ticket - Police Mistake

Hi Guys,

I need some help/ advice.

Today I got in my mail box a traffic ticket. NOT fun.
Cause: Running a red light in Bern.

Never in my life have I ever run a red light! I am the most careful driver. I kid you not.

Those are the very strange details:

1) Yes, I passed on the street but not at the time of the ticket.

2) Ticket has the time of 15:19.

3) I have the receipt of a purchase I made for my dog ( credit card proof and actual receipt ) at 15:35 - local Fessnapf store.

4) Driving from the point where I got the ticket to the dog store, takes 10 minutes as there is a construction site since June ( 8 the least ). I drive in this area every single day so I know.

5) I bought many things and every time I go to this store I take at least 20 minutes browsing around dog stuff. My dog loves to play with other dogs there.

6) Then I have other receipts after that but I guess that does not matter.

7) On the fee ticket says that the red line was crossed at 11:51 seconds. In my head that means that I saw the red line, did not care and crossed it anyways. %%&&!!

8) This is NOT the case, of course, as I crossed absolutely NO red lights. Maybe a yellow, but never a red.

What should I talk to the police to clarify this mistake? Fee is CHF250.00 and I am 1000% sure I did not cross a red light. 11.51 seconds is a lot in my opinion so I don't think that justifies also that they say the yellow became red while I was crossing over.

How can I prove that I did not run a red light? Do my receipts count to calculate the time?

If they have a photo, which they might have because I passed the street, how do I know that this photo was taken on a red light?

I want to better understand so I can go to the police and clarify this matter tomorrow.

If you're sure you didn't do it, then ask to see the photos. You'll end up with an extra fee if you did, but if it was a mistake then you'll be fine.

Pay and move on??? Why?
Why should I pay and move on when I absolutely know that I did not run a traffic light?

I know how it works in here, I arrived here 8 years ago.

And in those 8 years, I NEVER had a single traffic fee.

So why should I accept what I genuinely think is a mistake?

If I was wrong, I would be paying this bill tomorrow morning, at the first hour.

I need an opinion of someone who understand what I should do.

At this point, I cannot accept a pay a move on.

A few years ago my husband got a very big fine for running a red light he refused to believe it was him ( tried to blame me ) he went to the police station, and they showed him the photo, he was even looking at the camara so it was a clear photo of him running the light I dont think the police would make a mistake.

Of course the Police can make mistakes, let alone cameras.

I am in complete shock after reading the other posts.

I will go to the Police tomorrow.

What should I expect to see in the picture? Front and back of my car?
Only one scenario possible for me now is that I crossed the green, stopped the car on top of the line as there was a car in front of me which had stopped. This is the only one scenario.
But I could not be there according to the time stamps on my purchase receipts.

That is so wrong ...

They have to have two photos right? One of the front and one of the back? That is the only way I can see what really happened.

I will take the opportunity and take my Resume with me. Will apply to work in there ... Not joking at all ...

just go and get the photo and you will see what happened. if you started on green and were held up by another car then i bet you will still get fined being blamed for not checking the crossing is clear before moving.

Police make plenty of mistakes. Misreading license plates, mixing up cantons, etc.

@OP: First step: check what's the procedure in your city/canton to obtain the photo.

One thing that is worth checking is whether the junction has a filter lane for turning left or right. It is not unheard of for you to be a bit inside the filter lane (when it is on red) but to drive through a green light (for your lane) - for example left turn filter lane (empty) and you overtake a cyclist (entering lane) and this triggers the left turn filter lane red light camera.

As mentioned before in these parts this happens at General Wille/Alfred Escher in Zurich frequently as trucks have to arc out to the left in order to make the corner (to the right) and will trigger the camera for the left lane.

To be honest with you, I'm not even sure if they will show you the photo. According to this website, they are not obliged to do so:

You can try to go to the main police station and ask for the photo/evidence that supports this fine - if they won't help then you can go to a lawyer and you can try and have it overturned. If you do that you should be 100% sure that it was IMPOSSIBLE for you to have run that red light.

So I called the police.

I spoke to an extremely nice officer. Maybe because my German is fluent ...Maybe because he is on a good day ...

I did not cross the red light. I was right. It was green when I passed through.

But he said that I stopped right after as there was traffic in front of me. So a little part of my rear-end was on top of the pedestrian crossing line when the red when off. In this i believe as there always lots of traffic in this street. At any time of the day.

He told me that unfortunately this is how the camera works. And that happens all the time in this one, as traffic is always heavy there.

He said I could request the photos but he never saw anyone winning ... so I would end up paying more.

So I thanked him for his help and will pay now the fee. ;-(
