UK Company Cars > 12 Months in CH?

Been searching around to see if anyone has done this and couldn't find anything.

We have a couple of UK Limited companies that provide cars to some of the employees. These cars are leased generally so we cannot end the leases without buying out of them, which we do not want to do as it is a waste of money.

So my question is that if we managed to get a permit for someone to be located in CH permanently, because they have a UK company car that they do not own, can it stay here for more than a year because legally it is owned in the UK (and properly taxed, insured etc.)?

will they still be being paid in the uk? it would open up some interesting tax questions here and in the uk.

I guess we could do whatever was required to pay them in either CH or UK or a part in each.

We were thinking of providing a CH living package and then benefits only in the UK. The payments would certainly be coming from the UK company via whatever means (this will cause permit issues but that's another question - we have a CH partner who can help with this).

I have this arrangement already but I am employed in CH to get my permit. Anything else is in the UK and taxed there. I own my own car though so it is clear what I must do with that.

I came across a recent example of something very similar that may be of interest. A German guy resident in Switzerland crossing the border in a car registered to his German company. He was told he could not bring the car in - not even for the year limit for personally owned cars - and was turned back at the border.

i don't get that

Have a colleague, she is German and still on the German contract, but she lives here in Switzerland and there are no issues including with her German registered company car.

With the EU agreements I don't see why this should be an issue? course it's not my area of expertise...

Maybe it was the boot full of Krugerands they didn't like???

With my friend it was not an issue either - for over 2 years. Then they did a random document check and .....

It could also be time related, contract related, permanance of residence related, or some other aspect only thought of by the Swiss authorities .

Thanks everyone. I guess the answer is then to see if it becomes a problem. Still better than buying out of the leases straight away.
