Re: Parking fine from a private company

Papa, I actually paid for the parking, but overlooked the time for about 20 minutes. Also the parking ground was almost empty, so I didn't really hurt anyone. If the ticket would mention any published reference explaining that "PPC (Private Parking Control) Wüst" is officially entitled to do what they do, I would pay without thinking.

To me, it looks like guys just watching the parking lots and collecting the fees into their pockets. I don't want to sponsor any of such activities.

Well, actually no you didn't. You paid for one hours' worth of parking. After that you were parked illegally.

It is rather like saying I paid for a beer at the bar but accidentally drank 5. Am I still liable for the rest as no-one else was drinking the beer and the bar was empty, and the beer would have just gone to waste anyway, as the pints were already poured.

Re: Parking fine from a private company

Funny. We've had people parking in our private spaces from time to time. We asked the police and they said there was little we could do.

I guess next time, I'll just put an einzahlungschein on their windscreen.

Call the police and then tow-away? Works like a charm.

But someone on EF suggested that putting an einzahlungschein would also be perfectly legit (never tried, seems like a hassle despite having legal cost insurance).

Re: Parking fine from a private company

while researching the legitimacy of PPC doing what they do, I found quite detailed explanations on the Cantonal Police website. There are ways of dealing with violators, but it's probably not worth the whole paperwork.

You've already spend more than CHF 40 of your time in 'researching' this case, writing about it here, talking to 'colleagues'.....

Mind you, I guess if you are a 'foreverstudent' you have that kind of time to waste...

Clamping cars is against the law in Scotland. They can be towed away by the poilce but never clamped.

Not in all cases. If a residents association decides to contract work out to such a firm, they can clamp or even tow your car away. The 'fee' to release the vehicle is valid. (This was done where I used to live in England as a means of stopping people from outside the community parking on pavements, in front of drives etc. and was over seen by the police.) No idea if it's legal here, but considering the owner / landlord of the spot may individually attach a fine and note to a car, I'd say there'd be no legal reason why a contractor can't do it, too

Anyone on the heat with this?

Re: Parking fine from a private company

Our company makes pickup and drop offs all over town, we have had some of these tickets in the past so i thought i would share:

First off i learned that they must have two people present if they wish to take you to court over the fine, two people at the place of ticket issue.

2nd they must in addition take a photo as proof of over stay and or illegal parking

3rd they have a way of finding your name and address from the plate number so expect a reminder from them if you dont pay up BUT for a 40chf fine un collected they have to pay 70 chf just to get you into a betreibungs thingy,

Do as we do, throw the fine away or use it to clean your windscreen, throw the reminder away or use it to wipe your ... We never hear anything past the reminders they send.

Re: Parking fine from a private company

Granted this is a somewhat old thread but got to say I find it funny that some private company issues tickets and people here say "violators" are practicing "illegal" parking. Illegal implies a law is broken. Yet I'm sure without a doubt that those making these "illegal" statements have absolutely no clue as to whether or not a law even exists. I had an experience in a ski area in Canada, private parking garage where you had to prepay. So you have an injury skiing or the lift is stuck or whatever and you could exceed what you prepaid. Even though there was an exit booth it was unmanned. Long story short, years of "violations" were thrown out and they had to issue refunds. Also in the US from what I've seen every parking area that is under some form of law has the statute number posted on the signage. That includes private parking lots which clearly states the statute that allows them to have unauthorized vehicles towed.

Maybe time restricted or verbot would be a better way of putting it

Just a reminder that it isn't always a good idea to extrapolate from other countries laws/social norms to Switzerland.

Last week I sat through the annual torture session that is our Quartier homeowner's meeting - much of the... um... heated discussion was devoted to parking issues.

Long story short, there are many people for whom the principle matters far more than practicalities, who are willing and ready to pursue those they deem in error, who see this as a duty... it's called civil courage here.

Parking scofflaws are waving a red flag at a bull. Never underestimate an upstanding citizen with a pair of binoculars, a notebook, and time on his hands.

At least not in SZ.

here's the OP

I actually paid them after I got the first reminder. The amount wasn't worth the hassle.

Re: Parking fine from a private company

Oh I absolutely agree with you. My observation was that it seems people here seem to more easily assume a law is being broken when there may be no law at all in fact going so far as to curse the purported law breaker with nothing more than assuming a law has been broken.

Re: Parking fine from a private company

It happened to us once. My husband called the company who issued the fine and explained to him our reason. The man tought it was a good excuse and told us to forget it.

Hi,

I also got "privately fined" yesterday for parking in a private area without a proper and ridiculously expensive piece of paper.
Now, the fine is for 100 CHF which is already interesting, as they state this is the amount they agreed in their internal regulations (also attached) .

Then they state I have 20 days to pay this slip, otherwise they threaten to bring this up to the police.

I really want to find out if they can actually follow up (foreign plates being an additional issue for them), but in order to be ready I would ask if you have any sources, GB-in-CH, and from which Canton.
They also state they have a right to block vehicles whose owner they cannot identify mit Pneukrallen. This is true according to other members of this forum, but I couldn't find any confirmation...
