Re: Parking fine from a private company

All of what you say is true, they have the option to go to the police with the fine if it isn't paid

Re: Parking fine from a private company

But of course putting bullshit on people's windshield isn't proof I owe them any money.

At any time I can (rightfully) claim not to have received or noticed this slip.

Also interesting is this part, can anyone provide an accurate translation?

If you mess around the final cost will increase many times the 100 you are being asked to pay.

Call the police and then tow-away? Works like a charm.

But someone on EF suggested that putting an einzahlungschein would also be perfectly legit (never tried, seems like a hassle despite having legal cost insurance).
I seeked legal advice and was told that police + tow-away is fine, but I can't charge "just like that".

exactly.. here its enforced through the police and geminde, unlike UK where you can safely ignore private tickets.

Sure you can claim, but it will be their word against yours and how do you explain they have the details of your car on the fine and can you proove beyond any doubt it was indeed elsewhere at the time and place......

Claim and at same time multiply fine by about 5.

You parked badly, you got caught, now payup like a man

Except that in the UK those private parking companies have absolutely no right to "fine" you and often scare you into paying by using legal jargon and idle threats.

If you get a private parking ticket in the UK, ignore it.
I got a private parking ticket in Australia once.
Should I ignore that?

I might go driving in Cuba soon. What if I get a private parking ticket there. Should I ignore that too?

And once in South Africa a friend got a private parking ticket. Should he...?

PS: I am not sure how the UK rules are relevant to this conversation about how fines work in Switzerland, but if you think its relevant, I'd like to broaden the conversation to include all other English speaking countries.

otherwise someone will feel left out...

I have no problem with paying actually, but I also want to make sure that they are also abiding by the law themselves.
It's not like they can do whatever they want just because it's their parking space: e.g. maybe they can only charge the 40 CHF stated in the traffic law for such offences or maybe their procedure is (as GB-in-UK suggested) faulty enough that they are not even entitled to any money at all.

Anyone can have the details of my car from looking at it on the street, I think you understand the difference between the police leaving a ticket and a private person printing a (not even signed) random receipt.

Re: Parking fine from a private company

if you have legal insurance ask them about it. if you look in the area you parked there should be a few signs giving ref to some s. art numbers and other blurb about geminde etc take a photo and also send that to your advisor.

they will tell you the real situation, not an internet forum where the majority of people cant read or speak german in a proficient manner to fully understand legal documentation.

I'll save you some time and money.

I got one, took it to the police, the police said pay it.

I paid the fine and heard no more.

Re: Parking fine from a private company

Hi,

My case is a little bit different but I hope someone can help. My boyfriend lives in Zh, he has a card for "visitors" and his car is registered in Valais. He put the card in his car, and we went on holidays. After 3 days he got 3 fines saying the card was not visible enough. A friend of us placed the card in a visible place. When we come back from holidays, we got one fine per day (10 in total or something), for leaving the car there. We can not find information regarding which privileges do you have with the visitor's card, and we wrote the agency and they gave us no answer. Any advice? We truly believed we were not doing anything wrong and this is not about 40 chf, is quite more...

Maybe I have it wrong but you want a random Internet forum to tell you what your rental agency local regulations are?

Re: Parking fine from a private company

No worries, I correct you because you are wrong. The agency is hiring a private company, Ppc, to control the parking, as it is discussed in this forum. I would like to know if there is any limitation for what they can do, if there is any regulation about how much they can charge, etc. I do not know so much about the law in Switzerland but for example in my country, if you don't put a clear advertise about something, you can not charge the client for an extra service. I know: we should not have been so naive and let the car there, but that is another story.
We called PPC, asking for the regulations. They said we can find them posted on the door ( we cant), and that they can not send them to us (?).

Re: Parking fine from a private company

I asked as the level. Of fines are not standard. . my agency with an official geminde backed sign is 20 chf to 100 chf...another area 50 m away also different agency it's 50-200chf. You need to look for the sign

Re: Parking fine from a private company

There is often an aluminium plate with black lettering, warning drivers about being on private ground and charging parking fines.
Usually the sign mentions the order number and the name of a justice of the peace.

So either pay up, or argue your case in front of the judge. Good luck with that then!

Given this thread I can understand why...They would have people calling them up incessantly telling them why they think they have been wronged. The company has had quite a bit of coverage in the press and some of their practices may be considered borderline, but this is not the case for you as you readily admit. So....you can pay the fine or wait until the police knock on your door with a fine that is twice as high. Your choice....
I don't know. A premium line number could be quite a money spinner! :P
