I think the explanation you quoted is just plain wrong, particularly at the time of the post.

The basic approach used to be, and AFAIK still is, that copies, including backups, for personal use are legal. Think of it as lending a book or a music cassette. Personal use meaning
1) the recipients are known
2) they are reasonably few (say, up to half a dozen, as if friends having a fun evening)
3) nothing commercial, no personal gain for anyone involved other than being able to enjoy what's being shared

That's why uploads are illegal, as both amount and identity of the recipients are usually unknown. It's also why binary usenet files and kinox.to are a legal means to download.

Isn't that a torrent site? By default do torrents upload while you are still downloading... which is Phils point.

Bottom line: the law was written by politicians, not engineers.

Nobody got into real legal trouble in Switzerland as the law might not be perfect but shows the intention of the lawmakers... to be relaxed about the issue and not lock up teenagers for downloading a marvel movie. If you want to be on the safe side, make sure your client does not upload, end of story.
