Swiss law. My Email account was stolen

hi everyone.
My email account was stolen weeks ago. I was able to get it back resetting the password. I even know the ip adress of the hacker. i know that person...
What does the swiss law say about if? I went to the police and told me that if the hacker did not use the information in my account for anything illegal, then i really cannot do much.
What would you recommend me? Is the Kobik really doing something? Should i look for a lawyer?

Don't use the same password for different accounts.
Don't choose a simple password.
Assume that the hacker has already used access to your mail account to change the passwords of other services.
Consider changing your email provider if you suspect a security breach there.

How can you know the person by the IP address? I find that hard to believe.

Thanks, I already have done that yet.
My qustion was more focused in what to do from the legal point of view. My email account had tons of personal information. Isnt that a crime in CH?what to do now?

Is the person known to you (is it a very targeted attack?) - if so, then it probably is worth going to the police to try to see if they can help.

Stealing of personal information is inconvenient, worrying, at least, but the question is what a person can do with that information if they are malicious.

Either way, you need some very technical IT information and someone who can really talk you through all the steps to make sure you have now managed to block further opportunities and have protected as best you can your personal information and possible consequences...

Google provides that functionality, you can check the ip address used to check your mail:

You can see if an IP has accessed you email but you can not know who is behind that IP address unless you get a court order.

Hence, I find hard to believe that you know who is behind that address.

Not true. Art. 143bis StGB: (StGB = Strafgesetzbuch = criminal code)

Unauthorised access to a data processing system

Any person who obtains unauthorised access by means of data transmission equipment to a data processing system that has been specially secured to prevent his access is liable on complaint to a custodial sentence not exceeding three years or to a monetary penalty.

Just go to the police. They'll be able to answer your question much better than a set of strangers guessing on the Internet.

If you don't like what they say then lawyer up and say goodbye to your money.

The OP already did and it looks like (s)he got misinformed by the police...

Disclaimer: I'm not a lawyer and I'm not giving legal advice but article 143bis StGB seems crystal clear to me.

I went to the police but, to be honest, the guy I talked to didnt look like an expert in cybercrime.

Maybe somebody was in a similar situation, who knows.

Yeah, the lawyer option still open.

Yeah, sorry, I misread your OP.

If you have proof of who it is, then even if they think it's too trivial to prosecute, I'd expect them to give some sort of warning.

Before spending money for a lawyer I suggest you go to the police again and specifically mention the article linked above, which clearly states that unauthorized access is illegal.

Thank you for your answers Mark75, the link you provided could really help.

The problem is that this is quite an specific thing. These are "new" cases for the police. Im wondering how to contact a special police department that are experts in cybercrime. I read something about Kobik. Does anyone know about them? I sent them an email but they didnt replay yet...

Your first stop should be the local police. Don't let them shoe you off, e.g. by telling they're not responsible: it's their job to forward your report, if applicable. Just say you want to place a report, thank you very much.

Since it's been weeks you probably want to contact the IP holder directly and ask them to not delete metadata on IP x.x.x.x for the time being until a formal order (must be issued by court AFAIK, which usually takes time) has arrived, as you're reporting that person for hacking. A provider is required to store metadata (in this case, among other things, which customer the IP was assigned to) only for so long (in CH for 6 months, I think). They're not obliged to honor your request, and rules for foreign providers may differ, but they may decide to. Try
http://centralops.net/co/ (enter IP in domain dossier field)
or
whois.ripe.net
to identify the IP holder, or google for additional sources.

If this IP address links directly just to one website owned by the hacker, and it's fixed, then it's possible via whois. Pretty dumb hacker though, not to cover his/her tracks in some way.

Do you know the person, or just the IP. Your initial statement was vague. Also, is the IP in Switzerland?

With regards to ongoing security, do you have any idea how they got your password? If they got it by, say, hacking your computer, then you need to clean that up before trusting the computer again. By "clean that up" I mean to reformat and reinstall everything.

Fortunately, the most common way for a gmail account to be "hacked" is when somebody uses the same password for both gmail and some other website. Then the other website is hacked and all the passwords stolen. So, if you did reuse your password, you probably don't need to clean up your computer, but you do need to change the password everywhere it was used, preferably without re-use.

You also should at least check the password of any website accounts which know about the gmail address - if access to gmail let them reset passwords, they might have done so and deleted the resulting email chain.

P.S. In addition to not re-using passwords, you can turn on 2-step verification for the account. This is slightly less convenient and you have to be careful not to lock yourself out if you lose your phone (I keep a printout of recovery codes locked up somewhere safe.), but it makes your account quite a bit safer.
