Are you at risk of legal prosecution in Switzerland if you use torrents to download files (games/movies/music etc)?

I have heard a number of different opinions from people here in CH.

Please just facts - this is not a thread on the morals of file sharing etc.

Please make the distinction between using Bittorrent for legitimate reasons and downloading copyright material without the copyright owners consent.

As I understand downloading copyright material (without consent) is not illegal in Switzerland but making it available for download (as you would be with Bittorrent) is.
