I take it you are talking about bit torrents here -

I haven't tried this yet, but in theory it should work - you could use a proxy VPN to mask your Swiss IP, therefore can't be traceable.

Make sure your client is set up that way.

Of course, you can use the Swiss IP address you are assisgned, and simply remove the torrent once downloaded - however, in the spirit of goodwill, it would be nice to give back summat you have gained -

It is legal to download but not to upload. 99% of the lawyers see it that way.

The thing about collection IP was a company called Logitec. But they mainly hunt German filesharers. German law is different in that way, also lawyers can make easy money with "threats to sue".

If you just download without upload you are fine. Even if you upload - I never heard of a case where someone got sued. That doesn't mean you should do it of course

Actually, that doesn't prevent you from uploading; if you watch carefully, you'll find that bit torrent shares parts of files as soon as they're downloaded, and depending on the popularity of a file and the number of seeders, I sometimes find that I've uploaded almost twice as much as I've downloaded by the time I finish.

Yes, I know that - but that can't really be helped unless you switch off the share ratio for uploading....

Regarding some of the replies...thanks for replying, but I know how p2p works.
I'm a swede stuck in Swiss (for the moment) and I download and share and have a Demonoid ratio Im damn proud of!

My gf is worried about gettin busted...well atleast what the swiss law says is ok or not (what they care about or not) ...so thats why Im asking for advice.

My german pretty much sucks and I wouldn't dream of searching for info in german...so.

I'm thinking of paying for a Rapidshare account instead of using torrents.
From what ur saying and what I've heard, downloading is legal but uploading/sharing is illegal? So a Rapidshare account would be safe then? (It's a fekkin sad day)...didn't think I would ever have to pay for stuff on the internetz...

Read the thread I've merged yours into for more information.

There is a Swiss company tracking P2P useage of IPs called Logistep, but its activities so far to my knowledge only have led to court cases abroad. The federal data protectors lost a case against Logistep in the second highest Swiss court and recently has announced that he'll take it to the highest: article.

My take on it isthis - but yet to be proved.....

If using a bit-torrent client, simply amend the settings with a Proxy IP that is not Swiss.

In theory, you will not be using a Swiss IP to 'upload', so you would not be breaking any laws. All traffic will be going through the proxy which depending where the proxy is from masks where you are in the world.

Again, this is theory, and I have not put this into practise as of yet....

Sounds like when I am only downloading via usenet. Everything will be okay for now? Until they revise the law? I never been fan from bittorrent it's so terribly slow.

Correct! Downloading via Usenet is absolutely/100 pc legal! Whereas downloading via a torrent server is legal too, uploading however (which happens at the same time as you download) is illegal. That's the legal situation in Switzerland, in the rest of Europe it's different.

Before I hear groans from anybody: The Usenet is an almost forgotten application of the Internet. It only can be used if your Internet Service Provider (ISP) gives you the right to do so (he normally charges extra for this). Usenet was well known before the introduction of the World Wide Web (WWW), besides e-mail it was the widest spread application. The Usenet can be compared to the today's "forums" (anybody from around the world can read and post contributions).

The torrent server system works via the WWW.
