As I've stated before this 100% legal is limited to criminal law. A rights owner could in theory still successfully take civil action for damages.

I'm also not comfortable with having a few of the solutions mentioned on EF and kindly ask you to not post more of them until I've confirmed that this is fine with current Swiss law.

When you know, how torrent works, you know if it is legal or not.
In Torrent , there is no Server, who holds the file.
Everyone using torrent will be a seeder (or uploader) aswell.
Uploading Files(protected with a copyright) is illegal in switzerland.
There are much faster ways to download without making an upload(like FTP server or file sharing platforms(like 180upload).
There are forums, which share the informations about the links to dl.
The forum is legal, the dl is legal in switzerland aswell.

I guess a more relevant question would be: is there even one example of a private citizen being fined/prosecuted for uploading from his house, for non-commercial reasons? (i.e. not making money from it)

Laws can be there for decades without being enforced. In the UK they have some of the strictest laws about this but the percentage of common folk being harassed about it is almost non-existent. Just people with websites who tried to make money out of it.

I don't think any common leecher (download and delete) has ever been prosecuted. I don't know about seeders though, those usually rent seedboxes anyway... we'll see what happens in the future with symmetrical internet (fiber) some people may start uploading a lot directly from home.

I you say downloading is legal but i think it should be the content what you download is weather legal or illegal.

no I am making general statement like ... i am not sure about the statement "all the movies which are availableon torrent for download from torrent are legal which are also marked as copy right?

Thanks Good info.. but what about some one upload illegal data outside Swiss and we download it it Swiss.
Like some legal software like Microsoft Office. this seems illegal...
