A) "Neglect" has not to be specified in the Tierschutzgesetz as it already is defined in the ZGB
B) the Tierschutz hundreds of times per year successfully intervenes in cases of neglect or cruelty, which shows that they find enough legal basis for their actions
C) you have to realize that quite many laws and regulations are not Federal but Cantonal, and many defacto-laws are not based on laws but on cases of precedence
