Yes, that would apply if they were in Switzerland. It has no bearing in the UAE and a Swiss court wouldn't get involved.

arwadelovely, I'm not clear whether you're trying to prevent your ex from applying for a Swiss passport for your child or whether he is attempting to force you to hand over another passport that the child holds. Re-reading your posts I get the impression that it's the latter rather than the former. If that is so then I think you need to be talking to the Jordanian embassy rather than the Swiss one as I assume that's the other passport he has.

And have you/your lawyer gone to the Islamic court to contest their decision? Have they seen your agreement with your ex?
