Moderator Note : This post was originally in response to a thread asking about the enforceability of additional costs to recover a debt when it has been assigned to a debt recovery agency. The gist of the article is that nobody can be forced to employ an agent (e.g. the debtor cannot be forced to employ a recovery agent). The costs must not be passed the debtor.

It's not part of OR, but in a different code.

Art. 27 Abs. 3 SchKG: "Niemand kann verpflichtet werden, einen gewerbsmässigen Vertreter zu bestellen. Die Kosten der Vertretung dürfen nicht dem Schuldner überbunden werden."
