Re: Contesting a rent increase of 14% in Zürich
Hi everyone - I would like to come back to this topic as I recently signed a rental agreement where there is a clause about the Mietzinreserve, referring to a rent increase due to "aufgrund Orts- und Quartierüblichkeit".
The real estate told me that they do not plan to activate this clause in the near future and even if they do I can refuse it.
Does anyone know whether it is possible to refuse such a clause, and how? Would I need to go to court? Was anyone in this situation?
This is what the contract says:
- Der Mieter anerkennt die angegebene(n) Mietzinsreserve(n) in Bestand und Höhe. Der Vermieter behält sich vor, diese zu einem späteren Zeitpunkt geltend zu machen.
- Vorbehalte für allfällige spätere Mietzinserhöhungen gemäss vorherigem Mietvertrag oder letzter Mietzinsanpassung:
aufgrund Orts- und Quartierüblichkeit
