I believe it is lawful and I also believe that you are in a collective insurance scheme which basically means that your employer will be charged based on the AHV salary declared at the end of the last year. As he can be audited on what the AHV amount is and as the insurance companies get a copy of the audit then it is most unlikely that he will accept your unilateral rejection of the policy for which he will have to pay anyway.
