Freelancing from CH for a client in Germany: anything special about billing?

I have a customer in Germany & I work remotely from Switzerland.

Is there anything special I should know about when billing my German customer (special EU-CH agreement or else)?

Thanks in advance

Re: Freelancing from CH for a client in Germany: anything special about billing?

I just called SVA Zurich, svazurich.ch, because I live in this canton.

And they said there was nothing special regarding taxes.

However, my German client might need an A1 formular. If so, one can request this document to SVA by sending them an email.

In any doubt, the best thing to do is to call SVA. They are usually very responsive & helpful.

ps. I believe the A1 formular states that you are registered as self-employed in CH, not much else.

The SVA has no idea about taxes, that's not their job... they do social insurances. All they care about is that you actually set up yourself as properly self-employed and pay your insurances... you do, don't you?

You can have clients all over the world. Only thing when writing an invoice is VAT. Depending on how much revenue you'll make will you have to start to charge it... otherwise you end up paying it out of your earnings and you don't want to do that...

I only charge VAT to my Swiss customers - not my UK customers. I would have thought there was similarly no requirement to charge VAT to German customers.

Which is of course correct, being out of the EU Swiss VAT is only chargeable to CH customers.

Oh ok, that makes sense. I'm surprised the staff from SVA did not tell me that. Yes, I do pay my insurances.

How do I know at what point I should be charging it?

Looks like I made special discounts without knowing it! How much VAT do I have to charge?

Gruenden.ch has information on its website regarding VAT in Switzerland:

This website says "Tax-exempt are: companies with a domestic turnover of < CHF 100’000”.

That's awesome. Didn't work much this year in the end so I don't reach that threshold

Re: Freelancing from CH for a client in Germany: anything special about billing?

I do believe you do not own the german VAT number from Konstanz...

The German VAT is slightly different from the Swiss VAT. For the Germans important is where your service has been made. For example, did you visit the customer in Germany ? or even sent him the product from german IP ?, so you have to bill with the German VAT. If you do not sent him the product from Germany, but from Switzerland so 0% VAT Germany and Switzerland. But be warned there are court cases where the Germans demanded 19% of the Swiss company because the customer was visited. I do use the phrase "Umsatzsteuerpflichtig ist Leistungsempfänger" on my invoices to Germany. For the CH Accounting they do see the client is not in Switzerland and for the accounting of the client in Germany it is clear that i did work from Switzerland.
