Re: Can I start a business with a B permit?

I was in your exact situation: B-permit holder wanting to found a company where I'm the only employee. So, I just called the immigration department and asked: they said "sure, no problem". Then I did it, as a GmbH! Of course, you should definitely call the Migrationsamt YOURSELF and get their answer for your particular situation, but I actually asked them a lot of hypotheticals as I also couldn't believe it would be so easy to found a GmbH with myself as the only employee and also having just a B-permit (which btw, in my case was expired and in the process of being renewed! no problem, they just sent me a new one)

It's pretty much hassle free once you DO have the B-permit in hand:
1. Go to www.startups.ch
2. Go through their wizard and fill in the data
3. They'll call you to discuss some stuff (I didn't even meet them)
4. They'll send you some paperwork to sign, you send it back, they do everything
5. Done*

(* well actually there will be some more steps, like paying various fees, sending some more letters etc, but it's straightforward)

If you will do it through startups.ch (which you don't have to btw) I can also recommend their sister company Findea for bookkeeping. I actually chose an accountant closer to where I was based first, but it didn't work out and I reverted back to Findea which I'm still with almost 2 years later, they are very professional!

Best of luck and PM me if you have questions, I'm happy to help.

But even for an EU B permit holder the law on the necessity for an accepted business plan is clear. I quoted this bit earlier in the thread.
.
Only holders of a valid C permit (settlement permit for third-country nationals), the spouse of a C permit holder or the spouse of a Swiss citizen have the legal right to establish their own business in Switzerland.

All other persons have no legal right to set up their own business. They must submit an application to the respective cantonal authorities. Apart from the necessary personal requirements, it is decisive in the evaluation that the company will have a "lasting positive effect or influence on the Swiss labour market".

I suggest doing a search on here for "Business Plan". I'm sure there is some good stuff from people with similar requirements but I haven't the time to sort the wheat from the chaff at the moment.
This didn't happen in my case. No one asked for a business plan. I had a B permit and non-Swiss spouse holding a B permit as well. No Amts I called ever told me about this requirement. Maybe this changed since 2015?

I am a non-EU citizen, and My husband is an EU citizen.
Her husband is EU. She will get an EU permit and have the same rights as an Eu citizen.

You're right. I'm wrong again. That's twice this week already. Departs sadly with tail between legs.
