Morning all,

I'm having trouble find the applicable rules on the use of business email disclaimers. Is there a standard wording here in CH?

Does anyone happen to know?

I got this recently at the end of an email from a (foreign) supplier, but cannot say what validity it has here (if any). It appears rather heavy weight. :

Der Inhalt dieser E-Mail sowie alle mit dieser Mail verschickten Dateien sind
streng vertraulich und sind einzig und allein für die Person oder das Unternehmen, an die sie adressiert wurden, bestimmt.
Diese E-Mail kann rechtliche, berufliche oder sonstige Informationen, für die Schweigepflicht besteht, enthalten. Falls Sie diese E-Mail irrtümlicherweise erhalten haben, dann löschen Sie diese bitte sofort.
Sie darf nicht kopiert, für irgendwelche Zwecke verwendet oder deren Inhalt an andere weitergegeben werden.
Die in dieser E-Mail gemachten Aussagen entsprechen nicht unbedingt den Ansichten des Unternehmens.
Stellen Sie bitte sicher, dass Sie ein geeignetes Virenschutzprogramm installiert haben, bevor Sie zu dieser E-Mail gehörende Dokumente herunterladen oder öffnen. Es wird keine Haftung für Viren übernommen.

As far as I understand an e-mail disclaimer is from the legal point of view total irrelevant and nonsensical.

Furthermore, if we follow the advice given in me.anon disclaimer no business could be done as the information must not be used for ANY purposes. "Sie darf nicht für irgendwelche Zwecke verwendet werden." :msnsarcastic: :msncrazy:

You can not compel anyone to a certain activity, or non-activity, simply by informing them of your compulsion.

Any disclaimer, saying anything, in any email simply isn’t worth the paper it isn’t printed on.

You would be better saying. “If you received this email in error, please act responsibly. Thank you.”

That sounds a bit like the famous quote attributed to Sam Goldwyn in the case of verbal contracts.
Mine was an email disclaimer which was never printed and which, apparently, was not worth the electricity used to illuminate the pixels on my screen. :)

Any contract, or any agreement between two, or more, parties requires at least tacit agreement by all parties.

If I sent you an email compelling you to pay me f2,000 be valid? So why should I be compelled to delete a missent message?

I lose respect for those who believe these disclaimers are valid and have any force at all.

Am I right in thinking that the sender operates internationally, and/or in Anglo/American countries?

If I received something like that in a purely Swiss context it wouldn't create a good
impression at all - "what a pompuos ass!" or similar would be my likely reaction.

Just be careful that whatever you do, do it in all four national languages, plus English.
