How do we get this money out? (BVG/LPP)

My wife is self-employed. She started her business unofficially 1.3 years ago to test the water. Once she was happy she contacted Sozialversicherungsanstalt des Kanton Zurich to officially change her status to self-employed. Two months ago she got the confirmation letter.

The confirmation letter back dates her self-employed status start date to 1.3 years ago. If you are self-employed you have the right to cash your BVG money so we looked at her Winterthur forms and the category that deals with this says-


I am taking up self-employment (or have been self-employed for less than one year) and am therefore no longer subject to mandatory occupational benefits insurance under the Swiss Federal Law on Occupational Retirement, Survivors' and disability pension plans (BVG/LPP). Documentary evidence enclosed: current confirmation from the AHV compensation fund.

We contacted Winterthur and they are refusing to give the money as the Sozialversicherungsanstalt des Kanton letter backdates her business start date to March 2006 (more than one year). I find Winterthur's reasoning bit unfair. She only changed her status few months ago. How could she have provided documentary evidence before that? Any idea on how we could get the money out? Is it worth arguing more with Winterthur or do we have no chance?

My guess is no chance but it's worth a try.

The problem is the business officially started 1.3 years ago - your wife just didn't bother to do the paperwork until later - big mistake.

Yes I understand your point but she did not want to change her status without first testing the water. There was also a chance back then that she would take full time employment. Looks like she won't be able to touch the 20k sitting with Winterthur. What a waste!

I don't see why there is this one year rule anyway. If you are self-emplyoed then you should have the right to take it out whenever you want! Ok end of rant.
