this was an 80 year old woman who suffered severe burns and originally asked for 20,000 to cover the cost of her medical bills. she can hardly be described as stupid or even greedy.

you present a false dichotomy. knives are supposed to be sharp. coffee isnt supposed to give you 3rd degree burns. non-stupid people spill coffee all the time on themselves, moreso if they're 80 years old. mcdonalds knew people were severely burning themselves on its coffee yet did not consider making it less hot.

again i'm not sure why i'm even debating this. it's a really marginal case that could have gone either way and i don't think it's stupid at all. it's really interesting in fact.

A little perspective...

1.35 mill USD sales per day @ 50 c per cup = 2,700,000 cups sold per day
over 365 days = 985,500,000 cups per year
over 10 years = 9,850,000,000 cups sold over the time period.
That doesn't include the free refils you get in the US, I guess.

Now, 700 cases of burns/claims over 10 years prior to the event

Do the maths, because my crappy calculator can't work out just how small the chances are of an accident.

...and yet you feel there is a compelling case for negligence.

As an 80 year-old, I hope I will have the sense to be a little more careful, knowing that I am no longer as strong or healthy or quick as when I was 70, 60, 50 or younger.

Marginal it may be, but it is strongly symbolic of the "blame" culture that exists.

I'm guessing that you're debating this precisely because it is interesting (which I, again, agree with, but for doubtless different reasons! ).

If they had all sat down in a cafe and had a proper cup of coffee with a saucer, like Europeans then this sort of thing would never had happened.

Some places (in the US) don't even offer cups/mugs even if you are staying on-site to drink

Another time I even upset the barista, again in the US, because I wouldn't let her put the cover on my cappuccino and she freaked out in case I burnt myself...

I can guarantee that when we make coffee at home (or at work) in the moka, it will give you 3rd degree burns if you spill it on yourself!

This is exactly the actionable offense here. Coffee should not be made with water that hot, because it will just taste bitter when brought above 87 degrees C.

Sorry, this probably goes against the grain of this thread but if someone had offered to pay to use my loo with a Maestro card I would not have been able to control my laughter.

How would the restaurant have put that on the receipt?
