Well, yes - but lets give the OP the benefit of doubt for a min:
It often not obvious when you view a flat for 15 mins before taking it, what the more subtle disturbances are. If I moved into a place above a fast food outlet, I would expect certain inconveniences etc, that goes along with that, but I would also expect - in this day & age - for it to have the correct environmental health standards in place and to adhere to them.
If the OP is telling the truth that the owners were refusing to use their extractor, then they may very well have been cutting other corners too. You don't get closed down because of a single person's complaint about an extractor not being used - you get closed down after several complaints that are followed by warnings & spot inspections. Ultimately, they may have bought on the closure themselves.

I also found it a bit strange that after one complaint about the smell a takeaway gets closed down. If only it were that easy! Good result for the OP but I'm guessing he was just the straw that broke the camel's back.
