The above link is a Mieterverband document (tenants association - German only, sorry) which basically says that if you have to go you have to go. Whilst one should be considerate towards one's neighbours that does not mean putting one's life on hold totally. It even says that showering should be tolerated but a bath (which is considerably noisier) not...

Indeed. I can't believe people honestly consider anything different (unless it's meant as a joke).
Yes, old buildings can be noisy. But she'll also wake up if you have to cough or sneeze loudly.
What if the child is sick and cries - is somebody really suggesting to gag or drug it?

If she's awaken so easily, she should apply for on-call work ;-)

What is this? Prison? Since when can people tell you when to Sh*t and when not to sh*t!??

It's your freaking right as a human being to relieve yourself when necessary.

The manager cannot legally throw you out for call of nature, regarless of which time.

If your neighbour rings the bell again at 3am, call the police.

Unless it says in your rental contract, which you signed and agreed to, that the house rules are no flushing after 10pm, then the apartment manager has to be on your side. If not you can take legal action against them and are almost guaranteed to win.

OP,

Consideration is a good thing when renting. That's why you shouldn't let the bathtub drain or take long showers at night, even the renter's association/ASLOCA says so. But there's a limit, if she has the balls to tell you to stop using the toilet, tell her straightforward to get a life and to contact your landlord to get you a more soundproof toilet which she can pay for in full.

Next time she shows up ranting about this issue, write it down and go both to your landlord and the local police. Have them give her in writing the consequences of repeated harassment for something this bloody stupid (ringing your door in the middle of the night can constitute "Lärmbelästigung".

You are permitted to poo and pee at night. You are permitted to flush to toilet at night. You are not permitted to go around to your neighbour at 3am to complain about him/her pooing or peeing or flushing the toilet.

If she does it again, warn her that you will inform the apartment administration and the police.

It is NOT illegal to use your toilet when you have to it, but I'm pretty sure it IS illegal to harass your neighbours in the middle of the night.
Bear this in mind as you phone the police whilst she is banging on your door at 3 in the morning. It would make even more impact if you are actually speaking to them as you open the door....

Knock on her door at 3am and tell her she is keeping you awake with her snoring. Then go back take a big dump and flush the loo, 5 TIMES!!!

Anyway, is she retired? I dont get the retired folk. I have some too, whilst they wouldnt dare knock on my door at 3am as they know what they will get from me, I have been known to toilet and shower at this time. They do strange things like wash all evening when they're home practically all day.

They do housework from 7am, even on weekends! WTF!

When I am retired, sure I might be annoyed to be woken up but jeez, I can lay in, and do as I please.

The rules from the Mieterverband usually apply, as they were agreed together with the Landlords' Association. However, you may have signed something else in your contract. Note I'm not advocating that one should not be allowed to do one's business when the body mandates so.

I think that any contract that signs away your right to exercise bodily functions and maintain a relatively basic level of hygiene would be considered invalid. I also can't imagine any landlord being as explicit as that in a rental contract. Forcing someone to do something they don't want to do by using illegal means. Ringing on your doorbell at three am to yell and scream at you for something that is not illegal is surely against your local "Polizei Reglement". Someone needs to stand up to these bullies and put them in their place.

GOOD NEWS!!! I just heard that the old lady will leave the appartment .Well, not because of me but I think her husband has Parkinson and she will be moving near her daughter,so she will take care of them. I am glad I did not do something stupid, I was calm all the time. But I feel sorry about her future neighbours probably they will have same problems like I did.
