Speeding into 2013

My friend just got a letter in the mail that he was doing 81 in a 60 zone at the start of February. The letter says he will lose his license for 2 years and get 1 year in jail. I am not sure about the fine(s) yet.

I will let interested folks know how this develops so they can be aware of how the new law is actually applied. I'm interested to hear your stories as well regarding this new law.

81 km/h or 81 over the limit?
21 over should be "just" 600 CHF

Is "your friend" a repeat offender? Please keep us informed.

Re: Speeding into 2013

I know he has had speeding tickets in the past, but nothing that seems particularly egregious. He's never lost his license before. As to another poster it was 21 over the limit, not 81 over, just to be clear.

I can see losing a license for a few months perhaps, I guess, but two full years of that and jail time seems pretty intense and unsustainable really at this level of an infraction.

The state loses much more by taking someone out of the workforce, and basically destroying their life. He'd lose his job, apartment, etc.

Re: Speeding into 2013

hi bronto, thanks for the information! i will pass that along to my friend. i think that level of punishment is enough to make a serious point and penalize someone instead of completely destroy them. thanks again, tmou.

The prison is probably a suspended sentence, very common after a minor car accident in CH as well.

Have you actually seen that letter?

Either your friend is a serious repeat offender or there's more to the story than just being 21 over the limit. Otherwise that's way over the top and I strongly suggest getting a lawyer ASAP.

The new law contains a mandatory one year jail sentence for going 50 over the limit in a 60 kph zone.

It sounds like there was alcohol in his blood or this was his fourth offense.

Re: Speeding into 2013

Interesting scrapes the OPs friends get into

Any anecdotal cases of father getting custody?

The only other thread the OP started. Pasted here without comment

Nope. One thread is about the facts of a new law, whereas the other....

Going at excessive speeds can also destroy peoples lives by putting innocent people in the graveyard. I guess you never knew anyone who died in a car fatality due to someone elses negligence.

Re: Speeding into 2013

I don't see why this is a complaint. Maybe from the police, it is. They seem to have the OP's "friend" bang to rights and probably have very good evidence.

It's great to get half of half a story.....
