Another Noise Complaint

I know this has been done to death but any advice on how to get revenge on my "neighbours"?

We have some noisy neighbours who live on the level below us in our apartment block, not directly below but next door. They regularly have friends over and as they smoke and have a small child, they sit outside on their balcony. This is not a problem for me if it is occassional or even until 11 or 12pm, this has become a more regular ocuurance and happen 3 or 4 times a week. We chose not to say anything not wanting to be killjoys.

However, every evening for the past week they have been outside talking laughing and playing music until 1 or 2pm, on sunday night they were out there til 2pm, so on monday we complained to the landlord. On monday night they did not make much noise but last night they were out there until 3pm. The landlord had obviously told them and they were mocking me speaking italian in an english accent and calling my kittens name. This made me soooo angry. We put up with it for a year now but this is the final straw! Any advice how I can seek revenge? Clearly this people are unreasonable so should I act the same?

I presume you mean am and not pm.

1st night - go downstairs politely knock on their door and tell them its too loud, can they go indoors please.
2nd night - go downstairs knock firmly on their door and remind them of your polite request the other night and if it continues, you will send an official letter to the land lord.
3rd night - go downstairs, bang on their door as hard as you can, tell them you have had enough and any more shit, you're calling the police.
4th night - call the police.

Either that or get a big bucket of water and pour it on them from your balcony.

I think you should have mentioned it to them first before going to the landlord.
If you were my neighbour I would have preferred you speak to me first or mentioned some time over the past year how loud and disturbing they can be.
We have a neighbour like this & after speaking to him (Honestly about 5 times) he has improved so much!
He still does everything he used ot do but now does it at a more reasonable time or on a weekend.

I think you could still rescue this situation with your neighbours (So ye can co-exist happily). You just need to knock on their door and explain your situation in a polite manner. If still acting like immature fools I personally would throw a house party

I agree, be the bigger man (or woman) and don't sink to their level.
Seeking revenge could lead to an intolerable ( more than it already is!) situation.
Have a word with your neighbour and explain how their behaviour is affecting you.

if they don't care, call the police. that's what the Swiss would do to you.

I don't think throwing your own party to be loud back would work. As, people who like to socialise as described in the OP would merely welcome the fact that you have chilled out and like to socialise like them too at times, albeit not as often.

My neighbours have complained about a lot, but never noise, and I am guilty of late night drinking and talking on the balcony many a time. But if they did complain about noise, and throw a party in retaliation, I would welcome it and feel better about myself than annoyed.

However, I dislike early morning noise, and they are guilty of that, albeit within the legal time frame. If these people are partying or being loud until 2-3am a lot, then what time are they getting up? I would assume not too early, but then you say they have children.

What are other neighbours saying?

Two main questions come to mind for me about this, before considering how to deal with it, is wondering why things have changed (or so it sounds from the OP).

When did this start to become a problem?
What are the temperatures like / how has the summer been thus far in your area?

I'm wondering if this late night noise coincides with improved weather - so maybe they are taking advantage of the cooler night time temperatures to enjoy the night air a bit more.

With things warming up here in Basel, I can easily imagine folks who have the time taking part in a "siesta" style lifestyle, sleeping away the heat of the afternoon and then giving in to life as things cool down after sunset.

Factoring in that possibility, perhaps you could ask them to tone it down a bit, as (perhaps?) you need to work and such late hours are disruptive to you - rather than telling them to knock it off outright.

Yeah to be honest, I wish We would have talked to them first, but as I dont speak Italian well enough, I thought it would better for the landlord to deal with it. I told the landlord I would not complain (and haven't) whilst it was on a weekend, but now I am at work very tired and unable to concentrate, after several nights with not much sleep.

I have spoken to one other neighbour and he said he has also complained and he has asked them to be quiet before and it did not work.

I think maybe the lady who lives there is no longer working, I used to see her coming and going in her car in the morning & evening, so if she is not working she is staying up late with her friends, and yes it is warm here, but they have air conditioning inside. I think the reason they chose outside is because they have a child around 1-1.5 years old, and they smoke out there, the childs bedroom is at the other side of the apartment so I think maybe it is quieter for the child.

We also have to "sleep" with all the windows closed, it has been around 30 here just recently and it is not confortable with no air.

If you are nocturnal, with the hotter weather, it is tempting just to keep your windows open, music turned up or sit outside to chat. With drink that gets much louder. The very reason they are doing that is because of the heat, the same heat that means most people after 11 will equally have their windows open trying to sleep if ahead of a working day.

If very occasional and at a weekend one may be deemed small minded to immediately complain, but persistent occurrences mean they are either spatially unaware (thick) or couldn't give a s**t. Tell them firmly once, then police and a letter to the landlord every time. Why should anyone have to put up with it or tread on eggshells?

You have complained verbally, so now:
  1. Write an official registered letter to the landlord detailing frequenbcy and times. Keep a log of necessary.
  2. If problem continues, call police each time it happens on Sunday-Thursday (consider Friday and Saturday fair game).

Thus is probably your only route now. With police involvement (normal in CH for these cases) they will be forced to take action.

In fact, team up with your neighbour and right a join registered letter. Then if that doesn't work, both of you call the police. if you co-ordinate your efforts you will probably have a bigger impact than just doing it solo.

And most of all, don't feel bad about it. There are some selfish, ignorant in this world and sometimes the only way of getting something done is to have a good old complain.

Also, join the Mieterverband asap as that will give you some protection in case the landlord decides in the future that you are the one causing trouble for any reason http://www.mieterverband.ch/zh_home.0.html

Jeeze me and the wife sit on the balcony most nights, often until midnight and later at the weekend.. Wonder if we annoy the neighbours!? Although they are often out too.

If you just wanna do something to make you feel better, it's always fun to defecate somewhere you shouldn't, could you aim one at their balcony? failing that do it in a bag and just throw it down there?

In my experience (housemates at uni, my neighbours in my old flat), these people couldn't give a toss who they're disturbing and won't stop even when asked politely. Call the police every single time it happens. When I was a student, I went with the getting my own back method (e.g. stamping around and shouting outside said housemate's bedroom door at 7am). Not sure that method would work in this situation. It lead to an argument which resulted in me screaming at her (imagine me snapping, Carrie style, after having had enough of repeated and frequent selfish behaviour in every aspect, not just noiuse) which then resulted in her staying with her boyfriend for two weeks because she was scared of me (good bloody riddance, at least I had some peace and quiet for a while). Not really appropriate when you're a proper adult, though...

Tonight, the plan of action is to go down with my boyfriend and knock on the door and ask them to be quiet explain to them that we can not sleep as we can hear every word they say, although after how childish they have been I don't think this will work. We will give them half an hour and then we will call the police. I am just very surprised no one else has called them, there are 3 or 4 families with children, who must be affected.

It sounds like a good plan. I am very much in favour of speaking directly to people and this is the first step I take every time. However, once they've been spoken to a couple of times and show absolutely no intention of changing, it's clear that they're the type of person who has zero consideration for others (and I in turn have zero tolerance for them). It's always best to remain calm, but sometimes people need a shock.

Peg has a point, it could very much be seasonal and people merely enjoying the summer thats arrived, which I personally don't begrudge. I am not easily disturbed though compared to others.

Of course, there is still a limit though and if they are truly being that loud, then they have to tone it down if it is a disturbance to more than one.

Maybe they even see it as revenge on something you have done, in a sense they are not so concerned because you have or do disturb or annoy them in some way or another.

The best solution is to not cause each other grief though, as it just spirals. Try to make peace and understand each others position and compromise. It doesn't always work, and people have to just sometimes put up, particularly if landlord and police recognise at times some minor infringements but nothing that warrants serious trouble.

Then it is a case of whomever can tolerate it or chooses to move.

I was thinking, seeing as she likes calling my kittens name, I might send her a gift from him. I know there are other people who sit outside on the balcony in our but these people are loud, 3 am on an when we have to wake up at 7 for work is too much! I know some other people who in our wake up at 6:30 so it is not just me.
