eBay.de is driving me absolutely crazy

Hello all,

This is the first time I post on "complaints corner". If this is not the right place, please let me know.

It all started with my husband and I purchasing 2 excellent used MacBook pros on eBay.de. We saw that the seller had hundreds of reviews and overall happy customers so we figured it would be fine, like most of our hundreds of purchases on eBay in the past decade. We paid with bank wire. Although we have always only used Paypal back in the US, it didn't seem like the case here in Europe.

The seller dropped off the package on July 8 at a dhl station in Germany. 2 days later the tracking it was delivered according to dhl, although there was no location info along with the status. We also didn't receive any email from Las burg(German mailbox service across the border), which usually would send us an email very quickly. We thought ok maybe las burg was busy and let's wait. Then nothing. Then in the next 4 weeks, the tracking status changed back and forth between "picked up", "Lahr" and "delivered". We contacted eBay, the seller, dhl and las burg so many times. Las burg obviously never got the package. Dhl couldn't seem to give us more info than what we could see online(we confirmed with dhl that the delivery address is correct). eBay said there is nothing they can do, we can either wait or sue the seller. The seller has not been very responsive to any messages we sent. He did reply and said he asked dhl to do a search for the package but nothing else. Then last weekend, the tracking finally said return to sender, we thought ok great the seller can just send it again with a more secure service when he gets it, but then now it says "package misrouted and now on the way to receiver"....and we know it won't be delivered to las burg for sure.

I am a photographer and depend on my laptop but I haven't had one for almost a month...and that is driving me absolutely crazy. we sold and shipped my old MacBook Pro on eBay.de a day before the original delivery date of the new ones. I bought extra insurance for it like I always did for valuable shipments. I understand things happen, but man that's over 3k euros. I didn't want to compare with the way it works in the US, but seriously if this was in the US, eBay would have stepped in long time ago. I know it's not the seller's fault that the package couldn't be delivered (although I do think for that much money he should have shipped with extra insurance or dhl express), but not responding in this case is simply not ok. Alright I have complained too much. Sorry about that it is really frustrating and we don't know what to do

Has anyone had bad experience with eBay.de or dhl or just situation like this? What should we do other than reporting it to german police?

Sounds more like a shipment issue than Ebay? I canīt imagine Ebay anywhere stepping in on what is a shipment issue.

Hope the seller gets the stuff back soon and can send it again

Yes I agree it is probably a system issue with dhl. I thought eBay should have stepped in because usually when something like this happened to us in the past, eBay would have ask the seller to refund us the money already. I guess some regulations here in Europe are different so eBay cannot do that

But yes thank you I hope this could be resolved soon....

Do not see where this is a eBay issue.
The only parties you can blame is your seller and DHL.

Before you can go to the police you must put your seller in official delay. Sent them a registered letter that they have to deliver within the next 14 days or refund your money. Only if that deadline has passed without receiving either money or goods you can take legal actions (criminal or civil law).

In some countries (yes, I'm aware Switzerland isn't one of those) the seller is responsible until the delivery of the item, not until handover to a courier.

E.g. in the UK, if a courier loses an item, it's the sellers responsibility to refund you or replace the item. What they then do to claim off the courier is not your problem.

So the OP may be used to a different system, and be looking for a similar legal recourse over here.

Right that makes sense. eBay messages are definitely not official. We just looked it up, apparently we need to send a letter to the seller and a letter to the local court where he lives. Time to google "how to write a demand letter"

In Germany it depends if it is a private or a commercial seller.
A private seller has only the obligation to hand it to a shipper, a commercial seller is also responsible that it arrives.

Good to know. I wasn't awared that in some countries the sellers are not responsible for whatever happens after they hand it over to a courier.

so Germany is the same as Switzerland?

Ah this just answered my last question.
So apparently this seller has a business at the address he mailed out the package. But he did say on the original description that he is a private seller...

Why did you pay with a bank wire? That's very unusual for ebay and should set alarm bells ringing. Anything I've ever bought from ebay.de has been with PayPal.

No I have never paid with bank wire back in the US, but it doesn't seem unusual here for sellers to accept only bank wires. Now I started thinking many sellers here don't use paypal probably because they can get away with it in situations like mine...FORTUNATELY, dhl tracking shows now that the package has been "SUCCESSFULLY delivered to sender's address" so we will ask for a refund and send a formal demand letter.
But yes I agree it would have been much easier if it was paid through Paypal.

I had a problem with DHL recently. I bought an item on Amazon.de for delivery to a pick-up depot in Waldshut. Long story short, I was first given a delivery date of 3 July. On 3 July this changed to 6 July. On 6 July, it changed again. And again. The delivery date changed 4 times on my Amazon account. Eventually, I was able to collect it, and discovered it had been delivered on the original date -- 3 July. DHL hadn't updated their records, so Amazon was not updated either.

What is the best tactic for the last 30 seconds of an auction sale? They say one should wait right up to the end ( 2 seconds before ) and then put in the maximum you want to pay. ( called sniping ). Any better ideas. 2 seconds before seems too close to the end. And what happens when all the other bidders do the same?

not sure about ebay but Ricardo extends by 3 minutes after a bid in the last 3 minutes.

The earlier bidder wins if 2 identical bids, auction sniper.com will do this automatically for a tiny fee.
