Bottom line, the normal noises a child will make - playing, jumping, laughing, singing - being a kid! - must be tolerated. This is part of everyday life.

There are limits, as the article describes, the most important is official quiet hours.

The reason I linked this article and not an official lawyerly text is that it comes from a parenting website. Before you take any steps I would urge you to put yourself in the shoes of a parent. Not only because it's the socially expected thing to do, not only because empathy is a good thing - but because understanding your neighbor's point of view is usually the most effective way to go about resolving a dispute.

Think very carefully before starting a neighborhood war. Because that is what you will be doing, especially if the building is generally family friendly.

Neighborhood wars get ugly, and tend to remain ugly for a long time. Think about what it will mean to your ability to live your own life as you wish if you start this. (Glass houses, stones, all that.) If you start this, you could still be fighting long after the noisy children have moved out and had children of their own. Seriously.

Also be aware that going the legal route could end up quite costly. Think many thousands. If you go to court and lose you pay the court costs, by the way, as well as your own legal fees.

Are you that attached to this flat? How much would it cost to move? Do a cost comparison of moving vs lawyering up.

Now I'm not saying roll over and tug your forelock, but I am saying think, long and hard, before you do anything.

Life in the overcrowded Swiss beehives most of us have to live in is hard, no doubt. But strife between neighbors rarely fixes problems, generally makes things even harder. If you can find a way to live and let live - or come to a friendly understanding - your life will likely be more pleasant than if you go to war and win. Because even when you win the battle you likely lose in the long run.

There's a saying in German: 'Kinderlärm ist Zukunftsmusik', children's noise is the music of the future. It's good to remember that we were all children once.

I'm not sure what would you like your neighbours to do - sedate their children?

It's not their fault the building is poorly insulated. (probably old standards)


Secondly, you never know when you might count on their understanding.....

Yes, exactly.
I have never, ever known of a case where, once lawyers were invovled, the neighbours managed to come to a peaceful, cooperative agreement.

I have seen some of the methods recommended in the many other threads on this forum actually work, so that more of the people in a block of flats can manage to live more peacably, more of the time.

After We read and read "contract condition" and "tenant rights", yes. there is of course article to be humble as tenant to respect around place include "noise". Finally we got a call agency today morning, (She was a very annoying voice to listen our problem) she said we have to send the report letter of this.

And? What is going on after??? is there anybody had or has same problem with me?? Let me know any idea for this, please. Seriously We are afraid of moving just a month after from new place...I wanna take a rest when i come back home....
Hi, I have gone through this. I talked to the neighbor directly many times - nothing happened. Instead she blamed me that I am sensitive to noise. They were really stubborn, even not ready to accept that they are making noise. So when they continued to do it after 10 PM then I called Police, they were fined. But then they started making too much noise between 7 AM to 10 PM. I complained to the agency many times, the noise was reduced but not to my satisfaction. Everybody in the building was quite used to it and it just depended on the luck that what kind (flexible, idiot, unaccommodating etc.) of person is living above one's apartment / direct in the floor above. I had a really terrible one.

Long story short, the construction quality of the apartments esp. before 90s in Switzerland is really bad to reduce the noise. You can forget the meaning of silence in such buildings. People can live iff everybody follows the general Swiss protocol.

Simply move to a newly constructed apartment , there are many getting built up these days and easily available. The tenant laws are very strong in Switzerland and legal battles can take long. I have heard even if the court asks the guilty tenant to vacate even then they can stay 1-2 years easily on the pretext of not being able to find a new accomodation.

Doesn't make sense for you to drag it to court esp. when they have young children which is seemingly a valid reason (that too making noise before 10 PM).

Buy a hard core porn video and turn the sound up full. Speakers should go in the bathroom so that it goes up the ventilation shaft.

My Swiss friends used to have this problem because they lived on the upper floor with two small kids. The elderly family downstairs was a nightmare, as if they never had children of their own (they did, but were all grown-ups so they forgot..). Long story cut - after a couple years of complaining to the house management and what not...the old couple decided to move to a senior home. Nobody was on their side btw, not even their sons. So there. Involving lawyers is a loss of money because you don't have a "case" to begin with.

HI.. I'd rather have noise.. then no noise like in small village like Vich is...... after all of the noises from the cars during the day and trucks.... when everyone has gone home it is toooo quiet........
